Joe Biden Changes His Tune On Packing The Supreme Court

Democratic presidential candidate Joe Biden declined to say in an interview Monday whether he would support adding seats to the Supreme Court, signaling a shift from the primary race when the former vice president said he opposed increasing the number of justices because Democrats would “live to rue the day.”“It’s a legitimate question, but let me tell you why I’m not going to answer that question,” Biden said in an interview with Wisconsin TV station WBAY when asked if he supports the concept of packing the Supreme Court. Democrats have increasingly expressed support for legislation to add justices to the court if Republicans push through with a vote to confirm a justice to replace Ruth Bader Ginsburg, who died on Friday after a battle with cancer. (RELATED: Democrats Threaten To Pack The Court If Republicans Nominate A Replacement For Ginsburg This Year) “It will shift the focus, that’s what [Trump] wants,” Biden said in defense of dodging the question on court packing. “Let’s say I answer,” said Biden, “then the whole debate’s gonna be about what Biden said or didn’t say. Biden said he would or wouldn’t. The discussion should be about why [Trump] is moving in a direction that is totally inconsistent with what the founders wanted.” “It is a fundamental breach of constitutional principle. It must stay on that and it shouldn’t happen,” Biden told WBAY. Even the Democrats opposed it at the time.” Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience. Louisville Police Department Declares State Of Emergency Ahead Of Grand Jury Decision Regarding Breonna Taylor

The Louisville Metro Police Department declared a state of emergency ahead of a grand jury decision in the Breonna Taylor case, according to an internal memo Monday. The warrant allowed police to look for drugs regarding an investigation into Taylor’s ex-boyfriend. Police responded by firing their weapons, killing Taylor. Former Sgt. Brett Hankison, who shot 10 rounds into the apartment, was fired after displaying “an extreme indifference to the value of human life,” according to a letter posted on the Louisville PD’s Twitter. Officers Myles Cosgrove and Sgt. Jonathan Mattingly are on administrative leave. “In anticipation of Attorney General Daniel Cameron’s announcement in the Breonna Taylor case, I am declaring a state of emergency for the Louisville Metro Police Department (LMPD),” the memo said according to NBC News. ‘Blow Up The Entire System’: Don Lemon Is Ready To Scrap The Electoral College, Pack The Court

CNN anchor Don Lemon said Monday that before Democrats could see substantive change, they would have to be willing to take radical steps.During a brief conversation at the intersection of their respective shows, Lemon told fellow anchor Chris Cuomo that they would have to be ready to “blow up the entire system,” get rid of the Electoral College and appoint additional justices to the Supreme Court. (RELATED: ‘I Think He’s Honest’: Don Lemon Admits He Loves To Watch Neil Cavuto, Says Chris Wallace Is ‘Not Really On Fox’) WATCH: Lemon opened his show by noting that Republicans had been against confirming Merrick Garland — then President Barack Obama’s nominee — in 2016, but appeared to be largely in favor of confirming President Donald Trump’s soon-to-be-announced nominee to replace the late Justice Ruth Bader Ginsburg. He then argued that Democrats would apply their principles consistently if they were the party in power. “I don’t know that. I think that most people don’t agree that idea,” Cuomo replied. “Which is why they don’t care about the difference between left and right. See, until you have a group of people that decide to consistently be better than what they reject, you are going to have people in the exact position they are now. Which is no matter what happens, everybody sticks with the team.” “We’re going to have to blow up the entire system,” Lemon shrugged. “You know what we’re going to have to do? Honestly? From what your closing argument is, you have to get rid of the Electoral College. The people —” “I don’t see it,” Cuomo shook his head. “The minority in the country decides judges and the president,” Lemon continued. Cuomo pointed out that getting rid of the Electoral College would require a Constitutional amendment. “If Joe Biden wins, Democrats can stack the court,” Lemon said. “And can do that amendment and get it passed.” Cuomo kept pushing back, making it clear that such an effort was likely to be an uphill climb. “It’s a tall task,” he concluded.

Trump Launches New Attacks Against Biden For Not Releasing A List Of SCOTUS Nominees

President Donald Trump launched a new wave of attacks against former Vice President Joe Biden during a Monday campaign rally in Ohio centered around the Supreme Court vacancy opened by the passing of Justice Ruth Bader Ginsburg.Trump has vowed to announce his nomination to fill Ginsburg’s seat on either Friday or Saturday of this week, and he met with Judge Amy Coney Barrett — widely considered to be the White House front-runner — before departing Washington, DC Monday afternoon. (RELATED: Watch The Moment Trump Found Out About RGB’s Death) “Joe Biden has refused to list the names of his potential justices because he knows they’re too extreme to withstand any form of public review,” Trump told the crowd of supporters in Ohio. “If Joe Biden and Democrats take power, they will pack the Supreme Court with far-left radicals who will unilaterally transform American society far beyond recognition. They will mutilate the law, disfigure the Constitution and impose a socialist vision from the bench that could never pas at the ballot box.” WATCH: The president additionally claimed that Biden can only pick from “far-left radicals” or he will lose support from the progressive wing of the Democratic Party. “If he does something even left of center — which would be acceptable I guess, we have no choice — if he did that he would lose the left,” Trump claimed. “If you found out who he was going to pick, he would be unelectable.” Biden announced in Philadelphia on Sunday that he would not release a list of potential nominees until after the election. Public Schools Across Country Promote Black Lives Matter, Organize Protests

Public schools across America have endorsed the Black Lives Matter movement.  Black Lives Matter has been linked to 91% of riots across America over three months, one study found.  Buffalo Public Schools incorporated Black Lives Matter into its elementary school curriculum.  Some public schools organized their own Black Lives Matter protests and encouraged students to attend. Public schools across the country have endorsed the Black Lives Matter movement and encouraged teachers, students and parents to do the same, with some schools organizing their own BLM protests, a Daily Caller News Foundation review found. The Black Lives Matter movement has been linked to 91% of riots across the United States between May 24 and Sept. 12, according to the US Crisis Monitor, a joint project of the Armed Conflict Location & Event Data Project and the Bridging Divides Initiative at Princeton University. Despite the close links between the Black Lives Matter movement and riots across the country, public schools have been a consistent source of support for the movement. Buffalo Public Schools integrated Black Lives Matter’s “guiding principles,” which include disrupting the nuclear family, into its curriculum for elementary school students, according to lesson plans obtained and published by Fox News on Friday. One such principle included in the lesson, “Black Villages,” calls for “the disruption of Western nuclear family dynamics and a return to the ‘collective village’ that takes care of each other.” Screenshot/Buffalo Public Schools lesson plan for grades 2-4 Milwaukee Public Schools held a Black Lives Matter Week of Action in February. The listed demands for the week’s events included: “Fund counselors not cops.” “Please join Ms. Seidel and other Buckman families for a Kid’s March to show support for the memory of George Floyd and Black Lives Matter. Families are encouraged to make signs and meet in front of Buckman at 3pm on Sunday, June 7th,” the principal of Buckman Elementary, a Portland public school, told students in a newsletter. Sabin Elementary School in Portland held a Black Lives Matter protest as well. A picture on the school’s website shows a crowd of more than 100 people, mostly children, standing with their fists in the air. The students and adults in the crowd, many of whom are holding Black Lives Matter signs, do not appear to be following social distancing guidelines in the photo. The school’s principal also promoted a “week of action” organized by the Movement for Black Lives, a left-wing coalition that openly seeks to abolish police and prisons. It is not a Black problem, but a global problem,” Muncie Community Schools, an Indiana school district, states on its website. The president of United Teachers Los Angeles (UTLA), a union representing 30,000 teachers, announced in June that the union board had voted to support disbanding the Los Angeles School Police Department in solidarity with Black Lives Matter. “We should be actively promoting Black Lives Matter,” UTLA President Cecily Myart-Cruz told EdSource in an interview the same month. “We need to have a set of demands that dovetail with Black Lives Matter. We have to have massive political education,” Myart-Cruz said later in the interview when asked what her plans were for the union. “People will say, ‘Not all police are bad,’ but we’re not talking about that,” she continued. “We’re talking about racism as a social construct, systemic and institutional racism, and wrapped on top is white supremacist culture, which is the dominant culture.” Neither Myart-Cruz nor any of the schools or school districts mentioned in this story returned the Daily Caller News Foundation’s requests for comment. Time Is Running Out For Revelations About Trump-Russia Probe

The window of opportunity for revelations about the Trump-Russia probe is rapidly closing with just 43 days until a presidential election that could unseat Donald Trump.  Senate Republicans and U.S. attorney John Durham are investigating multiple angles related to FBI, CIA and State Department activities related to Trump and his associates.  A number of documents have been declassified over the past three years, and four government reports have been issued. But many questions about Russiagate remain unanswered.  With only 43 days until the election, the window of opportunity to get to the bottom of the U.S. government’s intelligence-gathering on the Trump campaign is quickly closing. The best hope for transparency lies in a handful of Senate committees and U.S. Attorney John Durham, which are all conducting investigations into FBI, CIA and other government agencies’ Trump-related activities. (RELATED: Trump Gives Barr Authority To Declassify Russia Probe Documents) The election presents hurdles for both sets of inquiries. Senate Republicans have struggled to obtain various government documents and to schedule depositions with government witnesses. Durham’s probe faces political headwind, with Democrats dismissing the investigation as a politically motivated witch-hunt aimed at helping Donald Trump. It is unclear if Durham plans to release a report of his findings before the election. The outcome of the election in November is also likely to determine how much the public will learn about the matter. A victory by Democratic nominee Joe Biden could sap political momentum from any Trump-related investigations. If Democrats also take control of the Senate in November, Republicans will lose control of the committees conducting the so-called “investigation of the investigators.” Democrats in the Senate and the House called this week for an inspector general’s investigation into Durham’s probe. Congressional Republicans have helped force out many FBI secrets about the Trump-Russia probe. GOP efforts prompted a Justice Department inspector general’s investigation that revealed the FBI misled the Foreign Intelligence Surveillance Court in order to obtain warrants to spy on Carter Page. Republicans along the way have uncovered details about the Steele dossier that have proved embarrassing for media outlets, the FBI and Democrats who pushed the theory that Trump associates conspired with the Russian government. The Justice Department and Office of the Director of National Intelligence have also declassified documents that shed light on the dossier and other aspects of the FBI’s investigation, dubbed Crossfire Hurricane. But even after a flurry of declassifications and publication of four different reports on the Trump-Russia matter, several aspects of the saga matter remain unanswered. The Steele dossier  The dossier, authored by former British spy Christopher Steele, played a key role in the FBI’s investigation of the Trump campaign, and the media-driven theories of collusion between the Trump campaign and Russian government. Reports from the special counsel’s office and the Justice Department inspector general have poked holes in the dossier. The reports said that Steele’s claim that former Trump lawyer Michael Cohen visited Prague to meet with Kremlin insiders was inaccurate. Steele’s allegation that the Kremlin was blackmailing Donald Trump with a sex tape has not been corroborated and is widely believed to be false. But what remains unanswered is exactly how Steele got key allegations wrong in the dossier. Footnotes from a Justice Department inspector general’s (IG) report of Crossfire Hurricane said that the FBI received evidence in 2017 that Russian intelligence officers may have fed disinformation into Steele’s source network. A footnote in the IG report also says that the intelligence community wrote a report in June 2017 that said two Russian intelligence officers knew in July 2016 that Steele was investigating Trump. The IG report said that an allegation that former Trump lawyer Michael Cohen meeting with Kremlin officials in Prague may have been disinformation, as potentially was the dossier’s salacious claim that the Kremlin has a sex tape of Trump. Igor Danchenko, the primary source for Steele, told the FBI in January 2017 that his source for the inaccurate Cohen claim also provided information about Carter Page. Some of Danchenko’s sub-sources have been identified in press reporting. The Daily Caller News Foundation has reported that Danchenko met in June 2016 with a Russian energy ministry official, Sergey Abysev, in Russia. Chris Steele arrives at the High Court in London for his defamation trial brought by a Russian tech entrepreneur. (TOLGA AKMEN/AFP via Getty Images) Documents regarding the evidence of disinformation have not been released. The FBI declassified memos from interviews with Danchenko, but has not released any other documents related to the Steele source. Republican South Carolina Sen. Lindsey Graham, the chairman of the Senate Judiciary Committee, has said that he will interview the two FBI employees who interviewed Danchenko.  (RELATED: Steele Source Had Meeting In Russia At Key Point In Dossier Saga) The FBI is also sitting on a trove of documents regarding Steele’s work as a confidential human source for the bureau and their efforts to investigate the dossier. FBI agents met several times with Steele during the course of the Trump probe, but documents from those meetings have not been released. The IG report also refers to FBI documents that say that the bureau developed concerns in 2015 regarding Steele’s associations with Russian oligarchs. The FBI also compiled a spreadsheet to track progress on investigating individual allegations made in the dossier. The document would likely shed light on the FBI’s investigative approach to the dossier. The Mifsud mystery Joseph Mifsud is one of the enduring puzzles of Crossfire Hurricane. George Papadopoulos, the former Trump campaign aide, claimed that Mifsud, a Maltese professor and diplomat, told him in April 2016 that the Russians had Hillary Clinton’s emails. The FBI opened Crossfire Hurricane on July 31, 2016 based on comments that Papadopoulos allegedly made to another diplomat, Alexander Downer. The FBI did not learn of Mifsud’s remarks until Papadopoulos disclosed the meeting during an interview with the bureau in January 2017. Democrats have suggested that Mifsud was working with Russian intelligence. Papadopoulos has suggested that Mifsud was working with Western intelligence agencies in order to set him up as part of the FBI investigation. Understanding Mifsud’s motives in sharing information with Papadopoulos would go a long way in showing whether the FBI had a legitimate concern about collusion. Mifsud has not been seen in public for nearly three years, since Papadopoulos pleaded guilty in the special counsel’s probe. Durham, the federal prosecutor, has investigated the Mifsud angle. He reportedly traveled to Italy, where Mifsud has worked, and asked Italian officials about the mystery professor. Joseph Mifsud at Stephen Roh’s office, May 21, 2018. Photo courtesy: Stephan Roh FBI informant Stefan Halper The FBI used Stefan Halper, a former professor at the University of Cambridge, to secretly record Carter Page and George Papadopoulos as part of Crossfire Hurricane. Halper, who had been an FBI confidential human source since 2008, first met Carter Page on July 10, 2016, three weeks before the FBI opened Crossfire Hurricane. Republicans have questioned the timing of that meeting. Halper received more than $1 million in contracts from the Defense Department’s Office of Net Assessment from 2012 through 2017. Sen. Chuck Grassley has questioned whether the contracts were used as cover for Halper’s FBI work. The Senate Judiciary Committee has declassified several transcripts of Halper’s interactions with Papadopoulos in September 2016, but Halper’s contacts with Page have remained hidden from view. The IG report said that the FBI failed to disclose exculpatory statements that Page and Papadopoulos made to Halper by denying links to the Russian government. The Senate Homeland Security and Government Affairs Committee voted on Wednesday to subpoena Halper along with 40 other witnesses for interviews as part of an investigation into Crossfire Hurricane. What did the CIA know?  Durham, the U.S. attorney, is reportedly investigating aspects of the Intelligence Community Assessment (ICA) which said that Vladimir Putin directed election meddling specifically to help Trump win the election. Some Republicans have suggested that CIA officials relied on incomplete intelligence to determine that the Kremlin meddled specifically to help Trump. Durham interviewed former CIA Director John Brennan last month about the spy agency’s involvement in creating the ICA and other spy activities it might have taken during the 2016 campaign. Brennan told the House Intelligence Committee in May 2017 that he provided the FBI with intelligence regarding Trump associates’ contacts with Russian officials. The nature and timing of that intelligence is still unknown. Unmasking requests Congressional Republicans have long focused on requests that Obama administration officials made for intelligence reports that identified various Trump associates, including Michael Flynn. In May, the Office of the Director of National Intelligence declassified documents showing that the Obama administration officials made 39 requests for Flynn after the election and before Trump’s inauguration day. While U.S. officials routinely submit requests that discuss U.S. citizens, Republicans have questioned whether Obama officials intentionally requested reports on Trump associates in order to collect politically damaging information on the incoming administration. Republican senators have asked for records about unmasking requests made since early 2016. A pattern of requests for reports on Trump associates might suggest that government officials intentionally targeted them for unmasking. Republican Sens. Chuck Grassley, Ron Johnson and Lindsey Graham are investigating the unmasking requests by seeking interviews with Obama officials who obtained the documents. Leaks to the media Since early in the Trump administration, Republicans have called for more investigations into leaks of classified information regarding the Russia probe. Republicans have argued that anti-Trump government officials have selectively leaked a steady stream of information aimed at portraying Trump and his associates of being Kremlin stooges. Carter Page, former foreign policy adviser for the Trump campaign, speaks to the media after testifying before the House Intelligence Committee on November 2, 2017 in Washington, DC. (Mark Wilson/Getty Images) Two of the most prominent leaks were to The Washington Post. On Jan. 12, 2017, Post columnist David Ignatius reported that Michael Flynn had a phone call with Kislyak. The FBI used the Ignatius column as a hook to arrange a White House interview with Flynn. He would later plead guilty in the special counsel’s probe to lying during the interview. Another leak to the Post led to revelations that the FBI obtained Foreign Intelligence Surveillance Act warrants against Carter Page. The story, published on April 11, 2017, led to investigations into the FBI’s decision to surveil Page. The status of the Justice Department’s investigations into the leaks is unknown. The second Trump dossier While the Steele dossier has received more attention, Clinton acolytes compiled a second dossier on Trump during the 2016 campaign. Cody Shearer, a longtime Clinton insider, wrote two memos in September and October 2016 that contained some of the same allegations of Trump sex tapes that are found in the Steele dossier. In a strange twist that has still not been fully explained, Steele was provided Shearer’s reports, and passed them on to the FBI. How the FBI handled the document is still unknown. Sen. Ron Johnson, the chairman of the Senate Homeland Security Committee, has obtained authority to subpoena Shearer and his associate, Sidney Blumenthal. Blumenthal, a longtime informal adviser to Hillary Clinton, provided Shearer’s memos to Jonathan Winer, who was an official at the State Department. State Department role in handling dossier Senate Republicans have investigated what role Obama-era State Department officials played in handling the Steele dossier. That inquiry has focused on Winer, who served as special envoy to Libya and was Christopher Steele’s main conduit to the State Department. Winer arranged a meeting for Steele and State Department official Kathleen Kavalec on Oct. 11, 2016. Winer also had contact with the founders of Fusion GPS, the firm that hired Steele. The State Department official served as a background source for two reporters who published stories touting Steele’s allegations before the 2016 election. Winer told the Senate Intelligence Committee that he destroyed his Steele-related records in January 2017 at the former spy’s request. Other former State Department officials were aware of Steele’s activities in 2016. Victoria Nuland, who served as assistant secretary for European and Eurasian affairs, approved FBI agent Michael Gaeta’s meeting with Steele in July 2016. Sen. Johnson obtained authority on Wednesday to subpoena Winer, Nuland and Kavalec. Schiltz, told the Times. “The question of what we believe as a religious matter has nothing to do with what we believe a written document says.” She Has Seven Children Barrett was born into a family of seven children and now has seven children herself — five biological and two adopted from Haiti, according to Newsweek. She met her husband, Jesse Barrett, a federal prosecutor in Indiana, at Notre Dame Law School, the publication reported. “Their family is radically generous and hospitable,” the Barretts’ long time friend, Carter Snead, told the Times. She does not often speak about her family, according to Newsweek, but she discussed them during her 2017 confirmation hearing which her daughters Emma, Vivian, and Tess attended while her other four children stayed home “with friends and fearless babysitters,” as Barrett put it. She Adopted Two Children from Haiti “Emma is 16. The first apple of our eye,” Barrett said at the 2017 hearing, according to Newsweek. “Vivian, directly next to Emma, is 13. Vivian is our miracle. Vivian joined our family—she was born in Haiti and she came home when she was 14 months old, and she weighed 11 pounds and she was so weak we were told she might never walk normally or speak. Today Vivian is a track star, and I assure you she has no trouble talking.” Her daughter Tess was also 13 years old in 2017, and during the hearing Barrett described her as “one of the most compassionate and determined people that I know.” “John Peter is 10, and like Vivian, he was born in Haiti,” Barrett said during the hearing. “He joined our family in 2010 when he was 3 years old after the devastating earthquake in Haiti.” She continued: “Liam is 8. Typically curious 8-year-old. And Juliet is our spunky 6-year-old.” Her Youngest Child Has Down Syndrome The youngest Barrett has Downs syndrome, which Barrett learned during prenatal testing, according to the Times. Many parents choose to abort when they discover the unborn baby has Downs syndrome, but Barrett did not. She carries Benjamin piggyback down the stairs every morning, the Times reported. “Benjamin, our youngest, is 5,” she said at the 2017 hearing, “and Benjamin has special needs, and that presents unique challenges for all of us. But I think all you need to know about Benjamin’s place in the family is summed up by the fact the other children unreservedly identify him as their favorite sibling.” It’s Rumored She Could Help Overturn Roe v. Wade Barrett’s potential nomination to the Supreme Court to replace Ginsburg has alarmed Democratic lawmakers and abortion advocates who fear that adding Barrett to the bench may result in overturning Roe v. Wade. “Amy Coney Barrett meets Donald Trump’s two main litmus tests: She has made clear she would invalidate the (Affordable Care Act) and take health care away from millions of people and undermine a woman’s reproductive freedom,” Nan Aron, president of the liberal Alliance for Justice, told the Times. Barrett was asked if she believed abortion is always immoral in the 2017 White House questionnaire, the Associated Press reported. “If I am confirmed (to the 7th Circuit), my views on this or any other question will have no bearing on the discharge of my duties as a judge,” she said. She has also said that she believes life begins at conception, according to Notre Dame magazine, and signed a 2015 joint letter that affirmed “the value of human life from conception to natural death.” Barrett suggested in 2016 during a talk at Jacksonville University that though a woman’s right to abortion, as understood by Roe v. Wade, may not change, the “question of whether people can get very late-term abortions, you know, how many restrictions can be put on clinics, I think that would change,” the Times reported. “If Roe v. Wade were coming against the court for the first time, I suspect that she would say there is nothing in the Constitution about this, and if you want a constitutional right to an abortion, people are free to add one to the Constitution, but it is not in there,” President of Catholic University John Garvey, who taught Barrett in law school, told the times. “That is not the question now. We have had 45 years of abortion jurisprudence.” Planned Parenthood’s action arm condemned Barrett before she was confirmed as a federal judge in 2017, saying in a statement that “the idea that Amy Coney Barrett would be a fair and impartial judge on issues of reproductive health is ludicrous.” Planned Parenthood did not immediately respond to a request for comment from the Daily Caller News Foundation on Barrett’s potential nomination to the Supreme Court. Amy Coney Barrett — who was already confirmed, despite only having one case — said judges shouldn’t follow the law if it clashes with their religious beliefs. #BadForWomen #CourtsMatter — Planned Parenthood Action – Text WeDecide to 22422 (@PPact) December 12, 2017 “We call on every United States senator to uphold a fundamental standard: If you oppose Roe v. Wade and would empower employers to deny women access to birth control, you should not sit on the bench,” Dana Singiser, vice president of government relations and public policy for Planned Parenthood Action Fund, said in a statement in 2017. “Planned Parenthood urges senators to reject the nomination of Amy Coney Barrett to the Seventh Circuit.” Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience. Republican Colorado Sen. Cory Gardner released a statement Monday confirming that he will vote to replace the vacancy left by late-Justice Ruth Bader Ginsburg on the Supreme Court, CBS Denver reported. “When a President exercises constitutional authority to nominate a judge for the Supreme Court vacancy, the Senate must decide how to best fulfill its constitutional duty of advice and consent,” the statement read. President Donald Trump is expected to make a nomination later in the week and reportedly met with Amy Coney Barrett at the White House. Terminally Ill Father Gets To Watch High School Son Play Football One Last Time With Help Of Nurse

A terminally ill father’s final wish came true, thanks to a nurse, after getting to watch his son play high school football for what could be the very last time. It all happened after hospice nurse Jerree Humphrey found a local dentist who was willing to fly Scott Sullivan on his personal plane to Belfrey to watch his son Cade Sullivan play football at Pulaski County High School on September 11, according to CNN in a piece published over the weekend. (RELATED: Alex Trebek Announces He Was Diagnosed With Stage 4 Pancreatic Cancer) “You could just not help but cry,” the hospice nurse shared, after watching the father and son embrace after the game in the touching moment. “He just embraced him so hard and was just so thankful for him to be there.” (RELATED: High School Football Player Gets EPIC Send Off As He Battles Cancer For Second Time) It comes after Scott was diagnosed in August with a terminal and rare form of cancer called leptomeningeal carcinomatosis and given just weeks to live. His one wish was to get to see his son play his first game of his sophomore year, but Jerree advised him a three-and-a-half hour drive by car wouldn’t be wise. “I thought you know you’re talking seven or eight hours in the car and I said I don’t know how safe that would be or how realistic,” Humphrey shared. Talking about the game a week later, Scott shared that “words could not be put into sentences or phrases to describe how I felt at that time. I was just so happy to see my son.”

Sens. Grassley, Ernst Promise To ‘Evaluate’ Trump’s SCOTUS Nominee: ‘Senate Democrats Wouldn’t Hesitate’

Republican Iowa Sens. Chuck Grassley and Joni Ernst both pledged Monday to “evaluate” a nominee put forth by President Donald Trump to fill the seat of the late Justice Ruth Bader Ginsburg.“I’ve consistently said that taking up and evaluating a nominee in 2020 would be a decision for the current chairman of the Judiciary Committee and the Senate Majority Leader,” Grassley said in a statement to the Des Moines Register. “Both have confirmed their intentions to move forward, so that’s what will happen. Once the hearings are underway, it’s my responsibility to evaluate the nominee on the merits, just as I always have.” Grassley contended there is “no such ambiguity in 2020” like existed in 2016 when the White House and the Senate were split between the two major parties. WASHINGTON, DC – MARCH 16: U.S. President Barack Obama (R) and Vice President Joe Biden (L) stands with Judge Merrick B. Garland (R), while nominating him to the US Supreme Court, in the Rose Garden at the White House, March 16, 2016 in Washington, DC. (Photo by Chip Somodevilla/Getty Images) He also accused Democrats of “a long, sordid history of politicizing the courts and the confirmation process.” “So, make no mistake: if the shoe were on the other foot, Senate Democrats wouldn’t hesitate to use their Constitutional authority and anything else at their disposal to fill this seat,” he argued. “The circumstances are different in 2020, where the American people elected a Republican President and Senate in 2016 and expanded the Republican Senate majority in 2018.” Grassley, who chaired the Senate Judiciary Committee during the contentious hearings to confirmed Justice Brett Kavanaugh in 2018, in July stated that if he were chairman he “would not have a hearing” on any potential vacancy, leaving any decision up to current chairman Lindsey Graham. Ernst told the outlet that the Senate has “much to consider over the coming days.” (RELATED: Gaetz Calls On Republican Voters To Oust Sens. Murkwoski, Collins If They Don’t Help Trump With Supreme Court Nominee) “The Supreme Court plays a fundamental role in the defense of our Constitution and in the protection of our rights and liberties,” said Ernst. “Once the president puts forward his nominee for the Supreme Court, I will carry out my duty — as a member of the Senate Judiciary Committee — to evaluate the nominee for our nation’s highest court.” With Alaska Senator Lisa Murkowski and Maine Sen. Susan Collins already on record against any potential nominee, Senate Majority Leader Mitch McConnell can only afford to lose one more senator.

‘You’re Talking About Something That Doesn’t Exist’: Juan Williams Denies Violence In New York

Fox News contributor Juan Williams appeared to deny the existence of recent violence in New York City during an explosive segment Monday on “The Five.”Williams got into a heated discussion with cohosts Dagen McDowell and Greg Gutfeld over protests that took place over the weekend at the homes of Senate Majority Leader Mitch McConnell and Senate Judiciary Committee Chairman Lindsey Graham. (RELATED: ‘Let Me Finish, Let Me Finish’: Greg Gutfeld And Juan Williams Clash Over Trump) WATCH: Cohost Dana Perino began the segment by noting that Democratic New York Congresswoman Alexandria Ocasio Cortez had called for Democrats to be “radicalized” over the loss of Supreme Court Justice Ruth Bader Ginsburg, who died Friday from complications of metastatic pancreatic cancer. “AOC says got to be radicalized. And that it’s not hyperbole,” Perino said.. “No. I was laughing at it but in their minds it’s not hyperbole. This is intimidation,” Gutfeld agreed. “And they would go to peoples houses, they’re not going to intimidate — they’re not going to those houses to intimidate those specific people. That’s to intimidate everybody else. Basically they’re saying, ‘you’re next.’ We are going to do this to McConnell but may be Jesse, you’re going to be next. This is what it does. It scares the crap out of people who should be speaking up.” “The worst thing about it as you keep hearing all these people say burn it down. If this nomination happens. Burn it down,” Gutfeld continued, adding, “You’re saying that after a billion dollars of damage was done with businesses and homes that were burned down. No class at all.” Perino pivoted to turn the question to Williams, asking whether or not the response to Ginsburg’s death would translate to votes for Democrats. “Sure,” Williams replied. “I don’t think you need AOC or Michael Moore or anybody else, Dana, to make this case. People are so upset over what is taking place. It’s an abuse of power. It’s breaking down American institutions. By the way, Dagen. They had people protesting, as you said, at McConnell’s house, Lindsey Graham’s house. There’s no violence. It’s a legitimate protest.” “Not yet. Not yet,” McDowell shook her head. Williams then accused McDowell of “pushing the fear button” to make her point. “I actually saw what happened in New York City in May and June and July and August!” McDowell shot back. “I’ve been attacked.” “Now you’re talking about something that doesn’t exist,” Williams dismissed her argument. “It does exist,” Gutfeld jumped back in as Williams continued to protest that there was no violence. Gutfeld went on to talk about his neighborhood being looted, noting that until Monday’s show had the hosts back in the studio, Williams had been living in Washington, D.C. He also said that there had been a 50% jump in the murder rate as Williams continued to talk over him. “That’s how bad — the cops look bored,” Williams concluded, adding one last thought. “Let me say this to your point, Dana, I don’t approve of protests at people’s homes. I don’t think that’s legit. But I do think when people say they’re upset, they have a legitimate right to protest. That’s what you’re going to see.”

Here’s How Trump’s Potential SCOTUS Pick Could Make His Obama-Era Regulatory Rollbacks Permanent

President Donald Trump has an opportunity to make his environmental regulation rollbacks permanent if he places another conservative on the Supreme Court before Inauguration Day, legal experts argue.  Adding another conservative justice will also greatly diminish Justice John Robert’s role as a swing member in which he occasionally sides with liberal justices, one legal expert at the University of Maryland suggested.  The president can pave the road for future deregulations with one more justice, Myron Ebell, an analyst at the Competitive Enterprise Institute, told the Daily Caller News Foundation. If President Donald Trump replaces the deceased Justice Ruth Bader Ginsburg with a conservative stalwart, then attempts to pull back on the president’s environmental regulatory rollbacks through the courts could be thwarted, some academics and legal experts say.Putting another conservative justice on the Supreme Court of the United States before Inauguration Day could also diminish former Vice President Joe Biden’s chances of implementing a wide-ranging climate change plan in the event he defeats Trump in November, according to Jody Freeman, director of Harvard Law School’s environmental and energy law program. “A further tilt of the Court in the direction it is already going … certainly won’t help the cause of environmental protection,” Freedman told the Washington Post Monday. Freedman cited what he believed was the conservative-leaning court’s skeptical position on regulations as reason to believe that the “cause for environmental protection” is in jeopardy. Ginsburg, an 87-year-old liberal icon on the SCOTUS, died Friday due to complications from metastatic pancreatic cancer. Trump initially told reporters Saturday that he plans to announce a nominee “next week” before pushing back his timeline Monday, citing memorial services for Ginsburg. Senate Majority Leader Mitch McConnell said in a Sept. 18 statement that the Senate would vote on Trump’s nominee. A legal decision from 2007 giving activists the opportunity to sue over climate change could be at risk under a more conservative court, according to one expert, which could endanger former President Barack Obama’s Clean Power Plan. Obama signed the 2016 rule in an attempt to rein in greenhouse gas emissions from coal power plants. SCOTUS issued a stay on its implementation in 2016. Conservative justices could use the Clean Power Plan as a Trojan horse to undermine the 2007 ruling in Massachusetts v. the Environmental Protection Agency, which required the agency to regulate carbon dioxide and allowed states and advocacy groups to sue over climate change issues, Michael Gerrard, an environmental law professor at Columbia Law School, told the Post. Former vice president Joe Biden speaks to the Chicago Council on Global Affairs on November 1, 2017 in Chicago, Illinois. Biden addressed the consequences of U.S. disengagement from world leadership at the event. (Scott Olson/Getty Images) “If Trump is able to name Ginsburg’s replacement, that decision becomes a big target for those who want to shut down EPA regulation of greenhouse gases,” Gerrard said, referring to the 2007 case.  The Environmental Protection Agency under the helm of former Oklahoma Attorney General Scott Pruitt introduced a replacement plan in 2018 called the Affordable Clean Energy (ACE) rule, which asks states to improve coal plant efficiency. The Clean Power Plan, on the other hand, mandated that such plants reduce gas emissions. Some experts believe the Clean Power Plan would force plants to close. (RELATED: Here’s How Trump’s Environmental Legacy Stacks Up With Obama’s Record) Democrat-led states and environmental groups sued the government to toss out the ACE, leading to a potential showdown at the SCOTUS. The U.S. Court of Appeals for the District of Columbia Circuit is preparing to hear arguments regarding the ACE in October, according to The Washington Post. Trump’s regulatory rollbacks are pending in the lower courts, legal experts argue. “The lower courts have played a powerful role in restraining the Trump administration,” Thomas McGarity, an environmental law professor at the University of Texas at Austin, told the Post. “Nearly all of the Trump administration’s rollbacks of Obama administration environmental initiatives are still pending in the lower courts and will therefore be ripe for review” in SCOTUS. The president rolled back more than 90 environmental rules and regulations during his first three years in office, including many of the regulations imposed by his predecessor, The New York Times reported in December 2019. The NYT relied on an analysis from Harvard Law School, Columbia Law School and other sources to keep tabs on Trump’s numbers during his time in office. In addition, a SCOTUS containing six conservative justices would create a seemingly insurmountable barrier for a future Democratic president, McGarity added. “If the people elect a new president and put both houses of Congress in the control of the Democrats, the Supreme Court with six conservatives could provide a hurdle that the agencies under new leadership will have a hard time overcoming,” he said. Myron Ebell, an analyst at the Competitive Enterprise Institute, agreed that Trump’s nominee, if confirmed, will likely make the president’s moves to peel back Obama’s environmental rules a permanent fixture in government. Ebell worked on Trump’s EPA transition team and is a fervent critic of Obama’s policies. “I think the Supreme Court before Justice Ginsburg’s death was quite likely to uphold most of the Trump administration’s environmental and energy deregulatory actions,” Ebell told the Daily Caller News Foundation. “The new court could be prepared to go much further in terms of striking down legislation and limiting deference to agencies.” Chief Justice John Robert’s position as the court’s swing member, occasionally siding with the SCOTUS’ liberal justices, will be diminished, Robert Percival, professor and director of the environmental law program at the University of Maryland, told the Post. “If a sixth conservative Justice is confirmed before Trump leaves office, Chief Justice Roberts no longer will be the swing vote and the other five conservatives would be free to embrace more extreme interpretations of the environmental laws,” Percival said. Roberts joined Ginsburg in April in ruling that a Hawaiian treatment plant could not exploit a loophole to avoid getting a Clean Water Act permit. SCOTUS ruled 6 to 3 in April that the wastewater treatment plant could not avoid provisions of the rule prohibiting the release of pollutants into rivers, lakes and seas, by pumping the pollutants first into groundwater. The Trump administration determined that the Clean Water Act permitted the treatment plant to avoid a permit through the measurer, according to the Post. American Removes Mother, Child From Flight When 2-Year-Old Refuses Face Covering

American Airlines reportedly kicked a mother and her two-year-old son off of a flight when the child refused to wear facemask. Most U.S. airlines require children over two-years old to wear a facemask, according to the ABC News report, and all passengers were forced off the plane because of the incident. “Rather than get themselves any bad press by escorting a crying mom and two year old off the plane, they forced everyone to deplane, and wouldn’t let us back on the flight home. Apparently before we got off the plane everyone who left before us lit up the crew in the gate area,” Rachel Davis posted on Instagram. (RELATED: American Airlines To Cut 5,000 Jobs, Despite $25 Billion Bailout) “I tried repeatedly, begged him, bribed him, pleaded with him, did everything I could while he was screaming and crying as I tried to hold him and put the mask on, feeling my absolute lowest of lows as a mother,” Rachel Davis, added. And it was not a bad, irresponsible mom either — she was crying and trying to keep the mask on and asking the flight attendants for help and advice on what to do.” “To ensure the safety of our customers and team, American Airlines requires all persons 2 years and older to wear an appropriate face covering throughout the entirety of their travel journey,” American Airlines said in a statement. “Policies are enforced and approved face coverings are made available at key points throughout the customer journey. We’ve reached out to the family to learn more about their recent travel experience and to address their concerns.” American Airlines recently announced that it would be forced to furlough 19,000 workers as of Oct. 1, if it did not get federal assistance, CNN reported. The news came after 12,500 employees agreed to retire early and another 11,000 for furloughs in October.

FACT CHECK: Did Ruth Bader Ginsburg Support Lowering ‘The Age Of Consent For Sex To 12’?

A viral Instagram post claims the late Supreme Court Justice Ruth Bader Ginsburg wanted to “lower the age of consentfor (sic) sex to 12.” Verdict: False Ginsburg did not advocate for lowering the age of consent to 12 years old in a report she co-authored in 1977. Fact Check: In the “Sex Bias in the U.S. Code” report Ginsburg co-authored in 1977, she pointed to S. 1400, a 1973 Senate bill that failed to become law, as an example of sex-neutral language in sexual offenses. The bill stipulated that a person would be found guilty of such crimes if they forced another person – not just a female – into sex using physical force, threats or intoxicants, or if the victim is “less than 12 years old,” according to its text. It did not seek to make a federal age of consent of 12 years old. The claim that she advocated for lowering the age of consent was first levied against Ginsburg during Supreme Court confirmation hearings in 1993 that would eventually lead to her confirmation as the second woman to hold a seat on the Supreme Court. Legal Affairs Analyst Thomas L. Jipping used Ginsburg’s argument in “Sex Bias in the U.S. Code,” to claim Ginsburg’s “social vision, as outlined in this report, includes: Drafting women, and sending them into combat. Legalizing prostitution, which she believes is protected by the Constitution. Lowering the age of consent for sexual acts to 12 years,” per the congressional record. Susan Hirschmann, executive director of the think tank the Eagle Forum, also made the same claim in official testimony during a hearing on Ginsburg’s nomination. However, Ginsburg’s report did not advocate for lowering the age of consent to 12 years old. In her analysis of some federal statutes, Ginsburg argued that defining crimes with language that only applies to women, such as defining rape as “an act of sexual intercourse with a female not his wife, by force or without her consent” fails to “comply with the equal rights principle.” She said such non-gender-neutral wording “[fails] to recognize that women of all ages are not the only targets of sexual assault; men and boys can also be victims of rape.” (RELATED: Did Ruth Bader Ginsburg Tweet About ‘Information That Will Lead To The Arrest Of Hillary Clinton’?) The report does not advocate for lowering the age of consent, but rather that gender-neutral language should be used in legislation. Despite that being the case, the false claim that she advocated for such a thing resurfaced after Ginsburg died on Friday from complications of pancreatic cancer.

FACT CHECK: Did Former NYT Writer Sarah Jeong Say, ‘We Need A Castration Lottery For White Men’?

An image shared on Facebook over 2,500 times claims former New York Times writer Sarah Jeong once said, “We need a castration lottery for white men.”Verdict: False There is no evidence Jeong made the statement, and the misattributed quote appears to come from a series of fake quotes that emerged on social media after she joined The New York Times in August 2018 as an editorial board staff writer. Fact Check: The quote about a “castration lottery” for white people was first shared on the online message board 4chan in August 2018, around the same time a number of other fake quotes misattributed to Jeong were shared on the website, according to Snopes. One user in that 4chan thread posted a fabricated tweet that Jeong supposedly sent July 31, 2018. There is, however, no record of Jeong making the statement. A search of her verified Twitter account, as well as her Facebook page, didn’t turn up any matches. An archived version of her Twitter timeline from early August 2018 shows no such tweet on July 31 of that year, and Check Your Fact also didn’t find any credible media outlets attributing the quote to her. (RELATED: Did The NYT Publish An Op-Ed Comparing Kim Yo Jong To Elizabeth Warren?) Jeong on Monday called it a “fake quote that had been debunked two years ago” in a tweet in which she also brought up a related incident where the fake quote inspired an email from a pastor from Michigan’s Macomb County. The pastor said that “little bitter Asian women” should be subject to female genital mutilation in response to the fake quote about castrating white men, according to a screen grab of the email Jeong tweeted Sept. 15. According to Snopes, the fake quotes emerged after social media users uncovered a number of actual tweets that some users criticized as being offensive to white people. Those tweets, which appear to have been posted well before she joined The New York Times’ editorial board, resurfaced after she was hired by the New York Times, according to Vox. In a Twitter statement, Jeong said she “engaged in what I thought of at the time as counter-trolling” and the comments “were not aimed at a general audience, because general audiences do not engage in harassment campaigns.”

Thousands Of Bikers Descend On Missouri For Rally, Heighten COVID-19 Anxiety

Thousands of bikers rallied at The Lake of the Ozarks in Missouri over the weekend, leading to renewed concern that the numerous, reportedly maskless attendees could increase the spread of COVID-19.The 14th Annual Bikefest, which normally draws over 100,000 people, lasted five days and featured over 300 bars and 50 live events, NBC News reported. “If I was worried about getting sick I would have stayed home,” one rider told MSNBC, declining to give their name. “But I wanted to have some fun.” Thousands of motorcycle enthusiasts gather in Lake of the Ozarks in central Missouri for an annual Bikefest at a time when the state is seeing a rise in Covid-19 cases. “If I was worried about getting sick I would have stayed home,” one attendee says. https://t.co/ClN7TPDRND — NBC News (@NBCNews) September 20, 2020 The rally caused concern among health experts as nationwide cases and deaths continue to rise as Missouri has recorded 116,032 confirmed COVID-19 cases and 1,916 deaths, according to The New York Times. “People are going to congregate from all over the country, and it will likely spur a chain of transmissions that has impacts in various different states,” Dr. Amesh Adalja, a senior scholar at Johns Hopkins specializing in infectious diseases, told The Daily Beast. “It will be a major task for public health officials because it is very difficult to track this mobile population.” But fear of catching the virus did not deter some locals from enjoying the moment. “It’s great to see,” Dan Ousley, and Ozarks local told the Daily Beast. “Honestly, I think that the COVID-19 thing is a little overblown, to be honest. We made national news for having large crowds, but we just want to live our life.” The Centers for Disease Control and Prevention has recorded 199,024 COVID-19 deaths in the U.S. as of September 21.

Black Lives Matter Webpage Opposing ‘Nuclear Family Structure’ Removed From Site

Black Lives Matter removed a controversial webpage outlining the beliefs of the organization from their site Monday without acknowledgement or explanation. The now-deleted ‘What We Believe‘ page outlined some of the movement’s key objectives, most notably the disruption of the “Western-prescribed nuclear family structure requirement.” This morning, when users visited the site, the page was no longer available. The organization, whose political activism was at one point was more popular than both major political parties, has seen a downward shift in approval ratings in the wake of ongoing riots throughout the summer. While 66% of Americans oppose the ‘Defund The Police’ movement, Black Lives Matter’s pages calling for the removal of police funding remain operational and a partner organization, Movement For Black Lives, continues to advocate for the abolition of the police and prison system. The sudden removal was first noted by Daily Wire writer Matt Walsh, who tweeted a screenshot of the deleted page this morning. ‘Financially Devastated’: 87% Of NYC Bars, Restaurants Couldn’t Make August Rent

A survey found that 87% of New York City restaurants, bars, and nightlife venues couldn’t pay their full rent in August as the city grapples with permanent business closures and unemployment. The survey by the NYC Hospitality Alliance also showed that 34% of these establishments couldn’t pay rent at all, Patch reported.  The results, which were released Monday, come ahead of the scheduled reopening of indoor dining at 25% capacity starting Sept. 30. If positive rates for coronavirus don’t show significant increase, the capacity will be raised to 50% by Nov. 1, according to Eater. People drink outdoor at bars and restaurants in the Hells Kitchen neighborhood of New York on June 7, 2020. (Photo by BRYAN R. SMITH/AFP via Getty Images) But many restaurants are struggling to remain afloat in the meantime, and outdoor dining seemingly failed to help many businesses survive the warmer months of the pandemic. “Restaurants, bars and nightlife venues have been financially devastated by the COVID-19 pandemic,” Andrew Rigie, the group’s executive director, said in a statement according to the NY Post. “Even before the pandemic when operating at 100 percent occupancy, these small businesses were struggling to stay open. Now we’re seeing widespread closures, approximately 150,000 industry workers are still out of their jobs, and the overwhelming majority of these remaining small businesses cannot afford to pay rent.” Of the 457 establishments across the city that were surveyed, 90% reported not being able to renegotiate their leases with their landlord while 40% said that they were able to get their rent waived. Some — 28.5% — had less than 50% of their rental obligations waived in August, and the same percentage of respondents said they had more than 50% of their rent waived. Manhattan real-estate sales experienced the largest decline in 30 years in July amid apprehension about coronavirus shifting buyer preferences. The rental market, however, was what brokers said will face the most immediate pressure since renters can leave the city easily. (RELATED: Manhattan Sees Largest Decline In Housing Sales In 30 Years, Apartment Contracts Down 76%) “The hospitality industry is essential to New York’s economic and social fabric, and to ensure the survival of these vital small businesses and jobs, we urgently need rent relief, an indefinite extension of outdoor dining, a roadmap for expanded indoor dining, covered business interruption insurance and immediate passage of the Restaurants Act by Congress,” Rigie added.

Elizabeth Warren, prior to dropping out of the presidential race herself, had not attacked Biden with the same intensity she had reserved for billionaire and former New York City Mayor Michael Bloomberg. “She knocked the hell out of Bloomberg but she left him sort of alone,” Trump said, adding that he believed she had done so because she “felt sorry” for Biden. “I don’t want people to feel sorry for our president!” Trump raised his voice then, adding, “I want other people — really — to feel sorry for themselves because we’ve got somebody that knows what they’re doing. We can’t have him.” “We can joke, we can play games, we can have fun,” Trump continued. “You can’t have this guy as your president. You can’t have — Maybe I’ll sign an executive order — you cannot have him as your president.” The crowd laughed and cheered as Trump continued to attack Biden, saying that people would vote for him because they felt sorry for him. “And maybe he’ll show up for an hour and a half in a debate, who the hell knows? I don’t know,” Trump said. “You know, you see the condition he’s in. You can’t have him as your president. And you know what? you can’t have her as your vice president, potentially going to be president.”

Gaetz Calls On Republican Voters To Oust Sens. Murkwoski, Collins If They Don’t Help Trump With Supreme Court Nominee

Republican Florida Rep. Matt Gaetz suggested voters should unseat Republican Alaska Sen. Lisa Murkowski and Republican Maine Sen. Susan Collins for opposing the confirmation of President Donald Trump’s upcoming pick to replace the late Supreme Court Justice Ruth Bader Ginsburg. Though Senate Majority Leader Mitch McConnell has said he would bring Trump’s selection to a vote, both Murkowski and Collins have stated they would not support installing a replacement for Ginsburg before the next presidential term. “If Susan Collins and Lisa Murkowski are going to withhold their vote for the president’s nominee, then Republicans in those states should withhold their votes from them,” Gaetz told The Washington Examiner in a piece published Monday. “What good are Susan Collins and Lisa Murkowski if we can’t count on them to fulfill their obligation to advise and consent during the term in which they’ve been elected?” WASHINGTON, DC – OCTOBER 02: Sen. (Photo by Chip Somodevilla/Getty Images) Gaetz told the Examiner that the court is Senate Majority Leader Mitch McConnell’s “legacy,” saying “he sure as hell better deliver on the president’s nominee.” While Murkowski won’t appear on the ballot in Alaska until 2022, Collins faces an uphill reelection campaign to win a fifth Senate term from Maine voters. Polling last week showed the Maine senator down by five points to Democratic challenger Sara Gideon. Gaetz also criticized Republicans for failing to give President Obama’s pick to replace the late Justice Antonin Scalia, Merrick Garland, a vote in 2016. (RELATED: ‘Easy Historical Precedent’: Marc Short Pushes Back On Jake Tapper Over Senate SCOTUS Confirmation) “Republicans should have held that vote,” he said. “And if they didn’t want to vote for him, they shouldn’t have voted for him. But that was a mistake then, and it puts us in a worse position now, and frankly, as we engage in the type of revolution that I think we need in our politics to achieve the full value of the Trump presidency, we need to see a Senate that takes more tough votes on more things going forward.”

Feds: NYPD Cop Spied On Tibetan Nationals For Chinese Government

Federal prosecutors on Monday arrested a New York City police officer on charges that he spied on Tibetan nationals on behalf of the Chinese government, according to a criminal complaint. The officer, Baimadajie Angwang, allegedly provided a diplomat working in the Chinese consulate in New York City with inside information about the New York City Police Department and its interactions with the Tibetan community. According to a criminal complaint that federal prosecutors in Brooklyn unsealed on Monday, Angwang reported on the activities of ethnic Tibetans to diplomats at the consultant, and also “spotted and assessed” Tibetan nationals as possible intelligence sources for the Chinese government. Angwang, 33, also “used his official position in the NYPD to provide Consulate officials access to senior NYPD officials through invitations to official NYPD events,” according to the complaint, written by FBI Special Agent Steven Deck. The complaint says that Angwang, an ethnic Tibetan born in China, initially came to the U.S. on a cultural visa. He overstayed a second visa before seeking asylum in the U.S. “on the basis that he had allegedly been arrested and tortured in the PRC due partly to this Tibetan ethnicity.” He is currently in the U.S. Army Reserves and holds a position that grants him access to classified information. Angwang has worked as a patrol officer in the NYPD and most recently held a position as a community affairs liaison in a precinct in Queens. NBC New York reported that Angwang was arrested on Monday. The arrest comes as the Trump administration has sounded the alarm over the Chinese government’s intelligence activities in the U.S. Last week, FBI Director Christopher Wray testified that the bureau opens a new investigation into Chinese spying or espionage every 10 hours. Federal Bureau of Investigation Director Christopher Wray arrives to testify before the Judiciary Committee in the Hart Senate Office Building on Capitol Hill June 18, 2018 in Washington, DC. (Chip Somodevilla/Getty Images) The complaint alleges that Angwang has maintained a relationship since 2018 with two officials from the Chinese consulate in New York City. One of the officials alleged to be Angwang’s handler is affiliated with the China Association for Preservation and Development of Tibetan Culture, according to Deck, the FBI special agent. (RELATED: Chinese Military Researcher Wanted By FBI Is Sheltered In California Consulate) The pair exchanged 53 phone calls or text messages from August 2014 to August 2017, the complaint says. They had 55 phone contacts from June 2018 to March 2020. The complaint says that Angwang’s handler congratulated him on a promotion within the NYPD. It also details conversations in which Angwang allegedly urged his handler to attend Tibetan community events in New York in order to keep tabs on potential intelligence sources. Prosecutors also allege that Angwang has substantial family and financial ties to the Chinese Communist Party. His parents are both members of the party, and his brother is a reservist in the PLA. Angwang is charged with acting as an unregistered agent of a foreign country, wire fraud, false statements and obstruction of an official proceeding. China, World Health Organization Blamed For Hiding Data About COVID-19 Outbreak, New Report Claims

An audit released Monday from the House Foreign Affairs Committee claims the coronavirus could have been prevented if China and the World Health Organization (WHO) didn’t cover up the early days of the outbreak. In the 96-page report, which builds on the June report condemning China and the WHO for covering up the virus, the Foreign Affairs Committee alleges the Chinese Communist Party (CCP) destroyed evidence and hid data. The background overview of the report also claims China nationalized their supply chains and limited export to U.S. companies to keep essential items in the country. The CCP allegedly harassed and detained journalists, scientists and healthcare professionals who tried to warn the world about the virus, according to the background overview. (RELATED: Twitter Suspends Chinese Virologist Who Accused China Of Hiding Evidence Of COVID Leaking From A Lab) Disciplinary notice issued to a nurse in China for speaking about a COVID-19 outbreak to her classmates & family further shows the CCP’s efforts to silence whistleblowers and critics as the virus spread. Full report: https://t.co/AadfbiwVjE… pic.twitter.com/wJEUFEOXK7 — House Foreign Affairs GOP (@HouseForeignGOP) September 21, 2020 The report claimed thousands of lives could’ve been saved had China been more transparent. “Research shows the CCP could have reduced the number of cases in China by up to 95 percent had it fulfilled its obligations under international law and responded to the outbreak in a manner consistent with best practices,” the report said, citing a study on Medrxiv, a Yale University-linked online clearinghouse for medical manuscripts, according to the New York Post. “It is highly likely the ongoing pandemic could have been prevented,” the report said. The overview said the CCP knew as early as mid-December that it was legally required to inform the WHO about the outbreak in Wuhan as an event “that may constitute a Public Health Emergency of International Concern” but that the CCP chose not to, violating international law. The overview also implicates the WHO for allegedly being complicit in the spread of misinformation. “The WHO has been complicit in the spread and normalization of CCP propaganda and disinformation,” the overview of the report said. The WHO also ignored warnings from the Taiwan Centers of Disease Control and the Hong Kong government about human-to-human transmission, according to the overview. “From the early stages of the outbreak, the WHO, under Director-General Tedros’ leadership, parroted and upheld as inviolable truth statements from the CCP,” the report said, per the NYP. “An examination of their public statements, including the praise heaped on the CCP’s handling of the pandemic, reveal a disturbing willingness to ignore science and alternative credible sources.” This isn’t the first time China and the WHO have been accused of hiding the outbreak. Chinese leader Xi Jinping allegedly asked the WHO to delay the release of information regarding the outbreak, German intelligence concluded. Jinping allegedly requested on Jan. 21 that WHO Director-General Tedros Adhanom Ghebreyesus withhold information documenting human-to-human transmission. The CIA has also been investigating China’s alleged coverup. Texas Republican Rep. Michael McCaul said the evidence linking China to a coverup was “disturbing” in an official statement. “We uncovered even more disturbing evidence about the Chinese Communist Party’s (CCP) coverup and WHO Director General Tedros’s gross mishandling of the virus that allowed it to turn into a deadly pandemic,” McCaul said. “It is crystal clear that had the CCP been transparent, and had the head of the WHO cared more about global health than appeasing the CCP, lives could have been spared and widespread economic devastation could have been mitigated.”

Here Are The 5 Republican Senators Who Could Determine The Future Of The Supreme Court

The death of Supreme Court justice Ruth Bader Ginsburg not only amped up tension for the upcoming presidential election, but marked the beginning of a contentious debate over the selection of her successor.Republicans hold a 53-47 majority in the Senate, meaning that a vote down party lines gives Republicans full control. However, the fate of any nominee put forth by President Donald Trump will be in the hands of a small group of GOP senators and their opinions on Trump’s right to appoint a justice mere months before the end of his term. While most senate Republicans have said that they will align behind Senate Majority Leader Mitch McConnell and confirm Trump’s nominee, some have yet to announce their position. Two have already said that they will oppose any nominee before the presidential inauguration in January. Only four Republicans need to break from McConnell to prevent the confirmation of Trump’s Supreme Court nominee, assuming every senate Democrat votes against confirming the president’s selection. While there was some speculation that GOP Senators facing competitive reelections would be hesitant to support Trump’s eventual nominee, Sens. Martha McSally of Arizona, Thom Tillis of North Carolina and Joni Ernst of Iowa all announced their support shortly after Ginsburg’s passing. (RELATED: These Vulnerable Senators Risk Losing Their Seats, Costing The GOP The Majority) Below is a roundup of which Senate Republicans will likely determine the makeup of the Supreme Court for the foreseeable future. Murkowski, who also opposed the nomination of Justice Brett Kavanaugh in 2018, said that supporting a nominee would create an unfair “double standard.” “When Republicans held off Merrick Garland because nine months prior to the election was too close, we needed to let the people decide,” she said in August, according to The Hill. “And I agreed to do that. If we say now that months prior to the election is OK when nine months is not, that is a double standard and I don’t believe we should do it.” (RELATED: Trump Takes A Shot At Murkowski After Her SCOTUS Comments) Collins, who is locked in a tight reelection bid, said that the Senate must act “fairly and consistently” when confirming Supreme Court nominees, and that she would be open to the “Senate Judiciary Committee’s beginning the process for reviewing [Trump’s] nominee’s credentials.” “Given the proximity of the presidential election, however, I do not believe that the Senate should vote on the nominee prior to the election,” she said. “In fairness to the American people, who will either be re-electing the president or selecting a new one, the decision on a lifetime appointment to the Supreme Court should be made by the president who is elected on November 3rd.” The Unknowns Republican Sens. Mitt Romney of Utah, Cory Gardner of Colorado and Pat Roberts of Kansas have yet to say whether they would vote to confirm a Supreme Court nominee before the inauguration. Democrats hope that Romney, the only Republican in the Senate to vote to convict Trump during his impeachment trial, may once again break with his party, though his only comment thus far has been to give condolences to Ginsburg’s family. His communications director denied a report that said he would vote against any nominee, and Romney said that he will not comment on the issue until after GOP senators meet tomorrow, according to CNN’s Manu Raju. Gardner, a Republican facing a competitive reelection in a Democratic-leaning state, has also been quiet on the issue, Politico reported. While a vote against any nominee would surely erode support from conservatives in the state, a vote for any nominee may drive away the moderate voters who elected him to his seat in 2014, according to Politico. Gardner has not indicated when he will announce his position. Sen. FACT CHECK: Did Time Magazine Publish A Cover Calling Donald Trump The ‘Worst. President. Ever’?

An image shared on Facebook nearly 300 times purportedly shows a Time Magazine cover that calls President Donald Trump the “Worst. President. Ever.”Verdict: False The cover image was never published by Time Magazine, according to a review by Check Your Fact of the publication’s covers. A spokesperson for the publication also confirmed it “is not an authentic TIME cover.” Fact Check: In the alleged magazine cover, a skull has been superimposed over half of Trump’s face. The title reads, “Worst. President. Ever. How Donald Trump has disgraced the highest office in the nation.” The supposed cover goes on to describe the president as a “Divider,” “Liar,” “Thief,” “Usurper” and “Manipulator,” among other words. The band “CAKE” shared the image on Friday with the caption: “Unfair portrayal? Explain why or why not.” (RELATED: Viral Image Claims A Person Who Receives 4 Ballot Applications Can Vote 4 Times) The image lacks traditional markings of a Time Magazine cover, indicating it has been fabricated. Typically, Time Magazine covers also have the publication date in the top right corner and “time.com” in the bottom right-hand corner, both of which are absent from the image. The image also lacks the traditional red border that adorns most of Time Magazine’s covers, further adding to its dubiousness. Kristin Matzen, communications director for Time Magazine, confirmed in an email to Check Your Fact that the image being shared “is not an authentic TIME cover.” Over the course of Trump’s presidency, Time Magazine has published more than 20 different covers depicting photos, caricatures or cartoons of Trump. None of them have appear to have depicted with the president’s face superimposed with a skull, nor have they called the president the “Worst. President. Ever.”

Florida Governor Ron DeSantis Announces Legislation Increasing Penalties For Rioting

Florida Governor Ron DeSantis announced new legislation Monday that would increase the penalties for anyone involved in a “violent or disorderly assembly.” The bill would also prohibit state funding for any local government that cuts their police budget.“Recently in our country we have seen attacks on law enforcement, we have seen disorder and tumult in many cities and across the country,” the governor said during a Monday press conference. “And I think that this has been a really really sad chapter in American history.” (RELATED: Governor DeSantis Sending Florida National Guard To Help With D.C. Protests) “I think we need to do more in terms of having a strong legislative response so that we do not always have to play whack-a-mole any time you have situations like this develop,” DeSantis continued. Under the new law, called the Combatting Violence, Disorder and Looting and Law Enforcement Protection Act, anyone involved in an assembly of 7 or more people where property is destroyed or someone is injured would face felony charges. It also makes it a felony to block roadways and destroy public property, including toppling monuments. Today I announced bold legislation that creates new criminal offenses and increases penalties for those who target law enforcement and participate in violent or disorderly assemblies. We will always stand with our men and women in uniform who keep our communities safe. pic.twitter.com/ITl5GmmrZJ — Ron DeSantis (@GovRonDeSantis) September 21, 2020 The bill makes it a misdemeanor to “harass or intimidate a person at a public accommodation, such as a restaurant.” If a person is charged with a crime related to rioting they would not get bail until their first appearance in court, and anyone who is convicted of participating in a riot would be ineligible for government benefits or employment by the government. Hitting a law enforcement officer, including with a projectile, would carry a mandatory minimum of 6 months in jail under the new legislation. Any local government that cuts their police budget would lose any state grants or aid. The legislation comes in response to over 3 months of nationwide protests and riots that erupted after George Floyd’s death May 25. During the riots, people destroyed property, burned buildings down, and clashed with police.

FACT CHECK: Image Claims To Show Man Who Started Multiple California Wildfires In 2020

An image shared on Facebook purportedly shows a man California police recently arrested for starting several wildfires in the state.Verdict: False The pictured man was arrested for arson related to California wildfires in 2018, not 2020. He was sentenced and jailed in 2019. Fact Check:  California, Oregon and Washington have been experiencing record-breaking wildfires since mid-August that have resulted in millions of acres of land being burned, according to BBC News. In recent weeks, social media platforms have become replete with misinformation regarding the West Coast wildfires, with this particular Facebook post claiming to show a man arrested for setting some of the blazes in California. “Police in California on Wednesday arrested a 32-year-old man accused of setting multiple wildfires that have scorched thousands of acres and forced mass evacuations,” the text accompanying a police booking photo reads. “The fire killed five firefighters and consumed more than 41,000 acres.” (RELATED: Were 7 Antifa Activists Arrested In Medford, Oregon For Starting The Wildfires?) Through a reverse image search, Check Your Fact found that the pictured man is actually Brandon N. McGlover, who was arrested in California in July 2018 on multiple counts of arson, according to ABC News. One of the fires prosecutors charged McGlover in connection with setting was the Cranston Fire, which burned over 13,000 acres and destroyed several homes in the area around the San Bernardino National Forest, per CNN. McGlover pled guilty in February 2019 to two counts of arson, receiving a sentence of 12 years in state prison and an order to pay restitution to victims of the fire, according to the Desert Sun. The California Department of Corrections and Rehabilitation inmate locator shows that McGlover is currently in prison and is not eligible for parole until 2024, making it impossible that he could’ve been involved with the 2020 fires. The Associated Press reported that lightning strikes caused hundreds of fires in California and at least one in Oregon. While at least one of the West Coast blazes is under investigation for possible arson, others were caused by human activities such as downed power lines or a spark from a “pyrotechnic device” used during a gender reveal party, per BBC News. Experts have said climate change plays a role in the size and severity of the fires, according to The New York Times.

Several Kenosha Schools Switch To Virtual Learning Day Before In-Person Classes Due To Surge In Teacher Absences

Several schools in Kenosha, Wisconsin switched to virtual learning after a surge in teacher absences, numerous sources reported.A Kenosha Unified School District spokeswoman announced to families late Sunday that due to the high number of teacher absences, school would take place through virtual classes rather than in-person for students at 7 districts, FOX 6 reported. “We genuinely apologize for this very late communication,” the statement says.  “Due to a surge of employee absences being reported for tomorrow, Monday, Sept. 21, we must move Bradford, Harborside, Indian Trail, LakeView, Lincoln, Reuther and Tremper to virtual learning for the upcoming week due to a lack of coverage for in-person learning. (Thomas Samson/AFP via Getty Images) “Students at each of these schools will be expected to log in for classes at their scheduled time from Monday, Sept. 21, through Friday, Sept. 25, in order to be marked present. Again, we apologize for this late notice and for the inconvenience this may cause our families.” The district said they had 276 teacher absences, although a statement by school officials to FOX 6 does not clarify the reason for the absences. The switch affects 3,600 students.  “Our system does not collect the reason why, so we are doing our research today. We have a 43% fill rate, meaning we have 43% of the positions needing coverage covered by a substitute, and the other 57% we will be working to cover in one of the following ways: with substitutes, by combining classes with other virtual sections, or by repurposing certified staff from other areas in the district. Teachers who call in sick will are not able to teach virtually or from home,” said Kenosha Unified School District officials. The district had three confirmed cases of coronavirus among staff, and a total of 10 confirmed cases, with 7 among students, according to FOX 6. (RELATED: Teacher’s Union Supports Strikes If Schools Reopen Without Safety Measures) The president of Kenosha’s teachers union recently called on the school district to reinstate districtwide virtual instruction in September after 2 students were infected with the coronavirus.  “We understand virtual instruction presents challenges for families, but KUSD is putting lives at risk by insisting on in-person instruction,” Tanya Kitts-Lewinski, president of the Kenosha Education Association, said in a statement to the Kenosha News Sept. 16. The Kenosha Unified School District did not respond to a request for comment in time for publication.

McConnell Says ‘Trump’s Nominee For This Vacancy Will Receive A Vote’

Senate Majority Leader Mitch McConnell gave a speech Monday remembering the late Supreme Court Justice Ruth Bader Ginsburg and said President Donald Trump’s Supreme Court nominee will receive a vote on the Senate floor. In a floor speech, McConnell honored Ginsburg and her service on the court, mentioning the successes in her life before moving on to explain how he would like to proceed with the Supreme Court vacancy. “Our nation is mourning the end of an exceptional American life. Justice Ruth Bader Ginsburg meant so much to our country. First and foremost, she was a brilliant, generational legal mind who climbed past one obstacle after another to summit the very pinnacle of her profession. Justice Ginsburg was a fixture on our nation’s highest court for more than a quarter of a century. She was not just a lawyer, but a leader. From majority opinions to impassioned dissents, her life’s work will not only continue to shape jurisprudence, but also enlighten scholars and students for generations,” McConnell said at the beginning of his speech. “The entire Senate is united in thinking of and praying for Justice Ginsburg’s family — most especially her daughter Jane, her son James, her grandchildren, step-grandchildren, great-granddaughter, and everyone who called her their own. Now, Mr. / Madam President, I ask consent that the following remarks appear at a different place in the Record,” McConnell said before moving on to discuss the vacancy. WATCH:  “President Trump’s nominee for this vacancy will receive a vote on the floor of the Senate. Now, already, some of the same individuals who tried every conceivable dirty trick to obstruct Justice Gorsuch and Justice Kavanaugh are lining up to proclaim the third time will be the charm. The American people are about to witness an astonishing parade of misrepresentations about the past… misstatements about the present… and more threats against our institutions from the same people who have already been saying for months that they want to pack the Court,” McConnell said. (RELATED: Mitch McConnell Lists What He Believes Are The Problems With ‘Today’s Democrat Party’ During RNC Speech) McConnell then went on to mention the confirmation process of Supreme Court Justice Brett Kavanaugh, saying the the “Me Too” movement tried to ruin Kavanaugh’s life with false allegations. (RELATED: Ginsburg To Lie In State In US Capitol On Friday — Will Be First Woman To Hold The Honor) “Two years ago, a radical movement tried to use unproven accusations to ruin a man’s life because they could not win a vote fair and square. Now, they appear to be readying an even more appalling sequel. This time, the target will not just be the presumption of innocence for one American, but our very governing institutions themselves. There will be time in the days ahead to discuss the naked threats that leading Democrats have long been directing at the United States Senate and the Supreme Court itself. These threats may have grown louder now, but they predate this vacancy by many months,” he continued. Ginsburg will lie in state Friday in the U.S. Capitol, an honor given to very few.

EXCLUSIVE: ‘Disgusting Attacks On Her Faith’: Sasse Condemns ‘Anti-Catholic Bigotry’ Against Amy Coney Barrett

Republican Nebraska Sen. Ben Sasse condemned “anti-Catholic bigotry” against Judge Amy Coney Barrett in a Monday statement to the Daily Caller News Foundation. Liberal criticisms of Barrett’s Catholic faith have re-emerged as President Donald Trump reportedly considers nominating her to the Supreme Court. “The conclusion one draws is that the dogma lives loudly within you,” Democratic California Sen. Dianne Feinstein told Barrett in 2017. “And that’s of concern.” Republican Nebraska Sen. Ben Sasse condemned “anti-Catholic bigotry” against Judge Amy Coney Barrett, a potential Supreme Court nominee, in a Monday statement to the Daily Caller News Foundation.“Attacks on religious liberty have no place in Congress,” Sasse told the DCNF. “The Constitution is pretty simple: No religious tests for office, period.” “During her confirmation hearing, Judge Barrett faced some disgusting attacks on her faith,” Sasse added. “The anti-Catholic bigotry she and other nominees have seen over the last few years is reprehensible.” Barrett, who was appointed to the 7th Circuit Court of Appeals in 2017, is reportedly one of three women that President Donald Trump is considering to replace former Supreme Court Justice Ruth Bader Ginsburg, who died Friday at the age of 87 due to complications of metastatic pancreatic cancer. “I’m saving her for Ginsburg,” Trump said of Barrett, according to a 2019 Axios report. Federal Judge Barbara Lagoa and 4th Circuit Court Judge Allison Rushing are also being considered, Fox News reported. President Trump: “I will be putting forth a nominee next week. It will be a woman.” #SCOTUS Full video here: https://t.co/pjfftGmqjx pic.twitter.com/QHIuB0BQUw — CSPAN (@cspan) September 20, 2020 “Last year, the Senate unanimously affirmed a resolution I introduced condemning bigoted, anti-Catholic tests, and Senators should keep that in mind,” Sasse added, pointing to a resolution he introduced after Democratic California Sen. Kamala Harris suggested that those who adhere to Catholic doctrine may be unfit for office. Sasse referenced comments made by Democratic lawmakers highlighting Barrett’s adherence to her Catholic faith when she was appointed a federal judge in 2017 – criticisms that have re-emerged as Trump considers nominating her to the Supreme Court. “Why is it that so many of us on this side have this very uncomfortable feeling that dogma and law are two different things, and I think whatever a religion is, it has its own dogma. The law is totally different,” Democratic California Sen. Dianne Feinstein told Barrett when she came before the Senate Judiciary Committee in September 2017. WATCH: Sen. Dick Durbin also questioned Barrett over an article she co-authored as a law student that included the term “orthodox Catholic,” asking Barrett: “Do you consider yourself an orthodox Catholic?” “If you’re asking whether I’m a faithful Catholic, I am, although I would stress that my own personal church affiliation or my religious belief would not bear on the discharge of my duties as a judge,” Barrett told the senator. Barrett addressed Feinstein’s and Schumer’s criticisms during remarks at Hillsdale College’s Washington D.C. campus. “We have a long tradition of religious tolerance in this country and in fact the religious test clause in the Constitution makes it unconstitutional to impose a religious test on anyone who holds public office,” Barrett said in May 2019. “I think when you step back and you think about the debate about whether someone’s religion has any bearing on their fitness for office, it seems to me that the premise of the question is that people of faith would have a uniquely difficult time separating out their moral commitments from their obligation to apply the law,” Barrett added. “I think people of faith should reject that premise.” Criticism of Barrett’s Catholic faith has once again emerged as lawmakers argue over who will replace Ginsburg. (RELATED: Here’s Where The Biden-Harris Ticket Stands On Taxpayer-Funded Abortions, Religious Freedom) “Amy Coney Barrett, the judge at the top of Trump’s list to replace Ruth Bader Ginsburg, has said we should always remember that a ‘legal career is but a means to an end … and that end is building the Kingdom of God,’” tweeted the Washington Post’s Ron Charles Sunday. REPORT: Vanessa Bryant Accused Of Kicking Her Mom Out Following Kobe Bryant’s Death

Vanessa Bryant’s mom has reportedly accused her daughter of kicking her out of the house following the death of Kobe Bryant. Sofia Laine reportedly told Univision reporter Dave Valadez about the falling out between the two during a sit down interview, Page Six reported Monday. This is sad and unfortunate – on many levels. She also told me that she wanted her car and she wants it now,” Laine said. It is unclear what exactly caused the falling out between the mother and daughter. The fallout between the two comes after Kobe and the couple’s 13-year-old daughter died in a helicopter crash back in January. Seven others also died in the tragedy, including the pilot, after the helicopter crashed into a mountainside in the Calabasas area. Vanessa has openly mourned Kobe on her Instagram profile. Two Special Elections Could Change The Makeup Of The Supreme Court Nominee Vote

Though Republicans hold a 53-47 Senate majority, its makeup could change before the start of the 117th Congress on Jan. 3, 2021, possibly complicating the GOP’s push to confirm another Supreme Court justice. If Mark Kelly, the Democratic senatorial nominee in Arizona, wins his election against GOP Sen. Martha McSally on Nov. 3, he could take office later that month, which would narrow Republicans’ majority. A vacancy on the Court opened when Justice Ruth Bader Ginsburg passed Friday evening from pancreatic cancer at the age of 87. Since the contest is a special election to finish the term of the late Arizona Sen. John McCain, the winner can be sworn in as soon as each Arizona county certifies its election results. Kelly has held a consistent lead over McSally in the polls, and the Cook Political Report rates the race as “lean Democrat.” President Donald Trump said Saturday that he would nominate Ginsburg’s replacement “without delay,” and said Monday morning on Fox News’s “Fox and Friends” that the announcement would come at the end of this week, according to The Hill. However, it is unknown how quickly the confirmation process will proceed, especially with Democrats floating the possibility delaying it. If Kelly is sworn in, only three Republicans would need to defect to block Trump’s nominee. The Arizona Senate race just became the race of history. Dem Mark Kelly is leading, and due to Az state law and senate practices could be sworn in as early as Nov 30th. So Kelly would be seated during lame duck as McConnell tries to force SCOTUS vote. https://t.co/eBIdjmL8xu — Sarah Reese Jones (@PoliticusSarah) September 19, 2020 Republican Sens. Susan Collins of Maine and Lisa Murkowski of Alaska have already said that they will oppose any nominee until after the presidential inauguration in January, meaning that only one more Republican would need to defect if Kelly was sworn in before a vote. (RELATED: Lindsey Graham Backtracks, Says He’ll Support Trump’s SCOTUS Nominee) In a statement Saturday, Kelly said that he believed the candidate who wins on Nov. 3 should choose the next justice, NBC News reported. “When it comes to making a lifetime appointment to the Supreme Court, Washington shouldn’t rush that process for political purposes,” he said. “I believe the people elected to the presidency and Senate in November should fill this vacancy.” McSally has said that she will support whoever Trump nominates, tweeting Friday that “this U.S. Senate should vote on President Trump’s next nominee for the U.S. Supreme Court.” A similar but less likely scenario could also occur in Georgia, where a special election to decide who serves the remainder of former GOP Sen. Johnny Isakson’s term will take place on Election Day. Over 20 candidates have challenged incumbent Republican Sen. Kelly Loeffler for the seat. If any single Democratic candidate in the race wins over 50% of the vote on Nov. 3, they could be sworn in early as well, the Atlanta Journal-Constitution reported, though the scenario is less likely due to the multiple Democrats in the race and Georgia’s Republican lean. Democrats Cite Upcoming Obamacare Supreme Court Case In Opposing Potential Trump Appointment. Here Are The Details

Prominent Democrats including Sen. Amy Klobuchar have warned that a new conservative justice on the Supreme Court could be a deciding vote in a soon-to-be-argued case reviewing the Affordable Care Act. In California v. Texas, both the district court and appeals court found the Affordable Care Act’s individual mandate provision unconstitutional and raised questions about the constitutionality of the entire law. The Supreme Court will review the constitutionality of the individual mandate, if the ACA can survive without the mandate and if the ACA is unenforceable across the country, according to a Kaiser Family Foundation report. A case that is set to be argued in front of the Supreme Court in November has the potential to find the Affordable Care Act unconstitutional, which has led Democrats to warn that a new conservative justice could be a deciding vote.Following Justice Ruth Bader Ginsburg’s death Friday, Democrats argued that the person President Donald Trump nominates should not be confirmed and have threatened retaliation, CNN reported. On Nov. 10, California v. Texas, the case concerning the constitutionality of the Affordable Care Act (ACA), will be argued in front of the Supreme Court and potentially a new justice. “Health care is on the line. There is going to be an oral argument on November 10th on the Affordable Care Act, literally the decision for hundreds of millions of people about whether or not they will be kicked off their health care if they have a pre-existing condition,” Sen. Amy Klobuchar, a member of the Senate Judiciary Committee, said Sunday on CNN. Senate minority leader Chuck Schumer tweeted Sunday that health care is at stake when it comes to appointing a new justice. (RELATED: Trump Pushes Back Timeline For Announcing New SCOTUS Nominee, Cites Justice Ginsburg’s Funeral Services) Further, Biden will begin campaigning on the ACA in the coming days and weeks as the battle over the Supreme Court vacancy continues on Capitol Hill, according to a campaign official, CNN reported Sunday. WATCH:  California v. Texas California v. Texas was first argued in 2018 after the Republican-controlled Congress passed the Tax Cuts and Jobs Act the year prior, according to a Cato Institute report. The legislation amended the ACA’a individual mandate provision, which fined any American who chose not to have health care, making the fine $0. Texas, along with several other states, filed a lawsuit against the federal government in February 2018, which argued that if the individual mandate was now $0, it could no longer be considered a tax and therefore the entire ACA was unconstitutional, according to Oyez. In the 2012 case National Federation of Independent Business v. Sebelius, the Supreme Court ruled the individual mandate was a tax and was a constitutional since it was a valid exercise of Congressional powers in a 5-4 vote. California joined the case alongside other states to defend the ACA’s constitutionality, according to Oyez. In December 2018, U.S. district judge Reed O’Connor of the Northern District of Texas ruled that because of the tax reform legislation, the ACA was now unconstitutional, according to Oyez. Because Congress had deemed the mandate to be “essential” to the ACA as a whole, the entire legislation was now invalidated, O’Connor said in his decision. President Donald Trump shows the signed tax reform bill in the Oval Office of the White House December 22, 2017 in Washington, DC. (Brendan Smialowski/AFP via Getty Images) “The Court today finds the Individual Mandate is no longer fairly readable as an exercise of Congress’s Tax Power and continues to be unsustainable under Congress’s Interstate Commerce Power,” O’Connor said. “The Court therefore finds the Individual Mandate, unmoored from a tax, is unconstitutional.” California then appealed the case to the Fifth Circuit Court of Appeals, which also found the individual mandate unconstitutional in a 2-1 decision. The court found that without the tax feature of the individual mandate, the provision was simply a command to buy health insurance, an unconstitutional exercise of Congressional powers, according to a Kaiser Family Foundation (KFF) report. In March, the Supreme Court agreed to hear the case in the upcoming term, according to KFF. The court will review the constitutionality of the individual mandate, if the ACA can survive without the mandate and if the ACA is unenforceable across the country. (RELATED: Trump Admin Calls On SCOTUS To Overturn Affordable Care Act) “The most far-reaching consequences, affecting nearly every American in some way, will occur if the Supreme Court ultimately decides that all or most of the ACA must be overturned, as the federal government now argues,” the KFF report said. The ACA was passed largely across party lines and signed into law by President Barack Obama in March 2010. California v. Texas has attracted the attention of governors and attorneys general nationwide with just four states not being involved in some way, according to KFF. The Supreme Court is expected to rule on it by June 2021. Nevada Judge Dismisses Trump Campaign Lawsuit, Allows All Voters To Receive Mail-In Ballots

A federal judge dismissed Friday the lawsuit filed by President Donald Trump’s reelection campaign that sought to overturn a Nevada mail-in voting law.The lawsuit was filed over Assembly Bill 4 (AB 4), which mandated all active voters in the state would receive a mail-in ballot for the election regardless if they requested one. The Trump campaign sued the state of Nevada in August to block the law which they claimed would lead to “inevitable” voter fraud. The law also allows mail-in ballots received up to three days after the election without a postmark to be counted. District Court Judge James C. Mahan granted Nevada Secretary of State Barbara Cegavske’s motion to dismiss the case Friday. The order said the Trump campaign failed to establish that “the interests it seeks to protect are germane to the organization’s purpose.” “The Trump campaign does not represent Nevada voters. The Trump campaign represents only Donald J. Trump and his ‘electoral and political goals’ of reelection,” the order said. The Trump campaign used a slew of articles regarding mail-in voting administrative issues that occurred in Wisconsin, New Jersey and New York as examples to back up their claim that the Nevada law would cause issues in November. Mahan said the campaign failed to describe how voters will be harmed by Nevada’s law. However, Mahan notes that the Republican National Committee and Nevada Republican Party satisfy the condition. Further the order said that allegations of “equal protection violations” are too general and speculative. The Trump campaign claimed the law violated “equal protection” because it would disenfranchise voters in rural areas since the law says county election officials only need to “establish at least one location in the county or city, as applicable for a ballot drop box.” (RELATED: Trump Campaign, RNC And Others Launch Lawsuit Against Montana Governor’s Executive Order Regarding Mail-In Voting) Mahan said an injunction against AB 4 would “eliminate the safeguard of a minimum number of in-person voting locations from all counties.” Democratic Nevada Gov. Steve Sisolak called the dismissal a job “well done” in a tweet Monday. I’m pleased to see a federal court judge has dismissed a lawsuit seeking to block AB4, a measure passed to expand options for Nevadans and provide for safe, fair & accessible elections during the pandemic. FACT CHECK: Did Ruth Bader Ginsburg Tweet About ‘Information That Will Lead To The Arrest Of Hillary Clinton’?

An image shared on Instagram claims the late Supreme Court Justice Ruth Bader Ginsburg tweeted, “I have information that will lead to the arrest of Hillary Clinton.” Verdict: False Ginsburg did not have a Twitter account, and there is no record of her ever saying or writing any such message about former Secretary of State Hillary Clinton. Fact Check: Ginsburg, the second woman to serve on the Supreme Court and a champion of gender equality, died on Friday from complications related to pancreatic cancer, NPR reported. She was 87. Shortly after her death, a tweet appearing to come from the late justice began circling on social media. “I have information that will lead to the arrest of Hillary Clinton,” reads the Sept. 18 tweet from @RBGofficial, an allegedly verified account that purports to belong to Ginsburg.  (RELATED: Has It Historically Taken More Than 67 Days To Vote On A Supreme Court Nominee?) But there is no evidence Ginsburg ever actually sent such a tweet. She did not have a personal Twitter account. The only Twitter account found with the handle @RBGofficial is unverified, has no tweets and appears to be unaffiliated with the late justice. The account, which was created in 2013, displays the name “Jorge” and has a guitar as a profile picture. The Daily Caller News Foundation found no record of Ginsburg making such a statement in any capacity. The message in the fake tweet alludes to an unfounded conspiracy theory that links Clinton to the deaths of various former colleagues and political adversaries. Fabricated tweets with the same message have previously been attributed to celebrities, such as Kobe Bryant and Anthony Bourdain. Clinton’s husband, former President Bill Clinton, appointed Ginsburg to the Supreme Court in 1993, according to a press release from the Supreme Court. Ginsburg even joined the couple for a lecture at Georgetown University last October. Following the news of Ginsburg’s death, Clinton tweeted a tribute to the late justice. Justice Ginsburg paved the way for so many women, including me. There will never be another like her. Thank you RBG. — Hillary Clinton (@HillaryClinton) September 19, 2020 “Justice Ginsburg paved the way for so many women, including me,” she tweeted on Sept. 19. “There will never be another like her. Fundraising Site ActBlue Breaks Donation Record In Aftermath Of Ruth Bader Ginsburg’s Death, Reports More Than $70 Million In One Day

Democrat fundraising site ActBlue saw its previous one-day donation record broken Saturday after the passing of Supreme Court Justice Ruth Bader Ginsburg. The fundraising platform for Democratic candidates and organizations reported over $70 million in donations Saturday, according to Politico. The previous record was set in June amidst the George Floyd protests, with over $41 million in donations. More than $21 million was raised on Friday night alone, with giving rapidly increasing after Senate Majority Leader Mitch McConnell announced he would hold a vote on a nomination made by President Donald Trump, per Politico.  Some of the biggest beneficiaries include funds targeting vulnerable Republican senators, says Politico. The Joe Biden campaign has experienced major fundraising success in recent months and now has a cash on hand advantage of over a $140 million compared to the Trump campaign.  Members of both parties used the death of Ginsburg as a part of fundraising efforts over the weekend. The Biden campaign sent out a fundraising pitch under the name of vice presidential nominee Kamala Harris, and the Trump campaign has centered fundraising efforts in recent days around the new Supreme Court opening.  Vulnerable Republican senators have taken a variety of stances on the Supreme Court issue. North Carolina Sen. Thom Tillis has already pledged to vote for any nominee put forth by Trump, and South Carolina Sen. Lindsey Graham has cited precedents set by Democrats as a reason to do the same. Maine Sen. Susan Collins said she doesn’t support a confirmation until after election day, while Alaska Sen. Lisa Murkowski went further, saying she would not vote for any nominee until after the presidential inauguration in January. Murkowski is the only one of the above who is not running for reelection this year. Meanwhile, Democrats are threatening drastic measures to try to stop the seat from being filled, including packing the Supreme Court in response if Ginsburg is replaced before January.

The late Supreme Court Justice Ruth Bader Ginsburg will lie in state Friday in the U.S. Capitol, an honor given to very few. Speaker of the House Nancy Pelosi announced Monday that Ginsburg will lie in State at the Capitol after she will lie in repose at the Supreme Court on Wednesday and Thursday, where the public can pay their respects. Annual Emmy Awards Pulls In Historic Low Rating With Virtual Show Due To Pandemic

The year’s virtual Primetime Emmy Awards show, due to the pandemic, hit a historic low rating, scoring 13 percent in total viewership compared to the year prior. The 72nd annual event, hosted by Jimmy Kimmel, struggled to overcome last year’s low ratings with less than 6.1 million tuning in for the ceremony compared to just under 7 million who watched the show in 2019 on the Fox network, according to the Hollywood Reporter in a piece published Monday. In comparison, the 2019 awards show scored a 1.7 in the same age group, which at the time was the show’s lowest ratings in the show’s history. (RELATED: Despite Declining Ratings, 2020 Emmys Still Happening With Jimmy Kimmel As The Host) To put that further into perspective, last night’s virtual award program was down 29 percent in the key the demographic compared the previous year. As the piece noted, once out of home viewing numbers get factored in later in the day, the numbers might change slightly, but they aren’t expected to top 2019’s all-time low numbers. The big winner for the night, right now, looks like the NFL showdown on NBC’s Sunday Night Football for the Seattle Seahawks victory over New England Patriots 35-30, which drew in three times as many viewers as the Emmy awards.

Mueller’s ‘Pitbull’ Blasts Probe, Says Prosecutors ‘Could Have Done More’

A top prosecutor on the special counsel’s team is criticizing the investigation and Robert Mueller for not going hard enough against Donald Trump, saying in a new book that prosecutors “could have done more” in their probe of the president.“Had we given it our all — had we used all available tools to uncover the truth, undeterred by the onslaught of the president’s unique powers to undermine our efforts?” Andrew Weissmann writes in the introduction of his forthcoming book, according to The Atlantic. “I know the hard answer to that simple question: We could have done more.” Weissmann, who was labeled Mueller’s “pitbull” by some Trump supporters, also told The Atlantic that Mueller let down the American public. “Absolutely, yep,” Weissmann told the magazine when asked whether Mueller failed the public. “I wouldn’t phrase it as just Mueller,” he added. “I would say ‘the office.’ There are a lot of things we did well, and a lot of things we could have done better, to be diplomatic about it,” said Weissmann. WASHINGTON, DC – JULY 24: Former Special Counsel Robert Mueller waits to testify before the House Intelligence Committee (Photo by Alex Wong/Getty Images) Weissmann, who oversaw the investigation of former Trump campaign chairman Paul Manafort, was one of the special counsel team’s most partisan prosecutors. He reportedly attended an election night party for then-Democratic candidate Hillary Clinton. After the special counsel’s probe ended, Weissmann joined the liberal MSNBC as an analyst. He was also slated to host a fundraiser for Joe Biden in June. Mueller and his team finished their investigation in March 2019 and released a report that said that prosecutors failed to establish that members of the Trump campaign conspired with Russia to influence the 2016 election. The report was far less definitive on the question of whether Trump obstructed the Mueller probe or the FBI investigation that preceded it. (RELATED: Mueller Team Members ‘Wiped’ Cell Phones, DOJ Records Show) According to The Atlantic, Weissmann asserts that Mueller’s report was “mealymouthed” on the question of obstruction. “Part of the reason the president and his enablers were able to spin the report was that we had left the playing field open for them to do so,” Weissmann writes in his book, according to The Atlantic. The Mueller report laid out evidence that Trump asked underlings to shut down the Mueller probe. Trump’s supporters have pointed out that the investigation was allowed to continue despite Trump’s frustrations with the probe. According to The Atlantic, Weissmann accuses Aaron Zebley, a top Mueller deputy, for the team’s timid approach to the investigation. “Repeatedly during our twenty-two months in operation, we would reach some critical juncture in our investigation only to have Aaron say that we could not take a particular action because it risked aggravating the president beyond some undefined breaking point,” Weissmann writes, according to The Atlantic. Justice Department documents released last week also show that Weissmann wiped data from two government-issued phones he used while working on the special counsel’s investigation. New Coronavirus Restrictions Enacted Across Europe As New Cases Rise

New coronavirus restrictions are being put in place in several countries across Europe as they struggle to deal with a rise in new cases.Spain, which was one of the countries originally hit hardest by the pandemic, enacted new restrictions in some parts of Madrid. The new rules close parks, gardens, and put a capacity limit on restaurants and cafes, affecting around 13% 0f Madrid’s population, according to a Euro News report. People were also told to not leave their neighborhoods except for basic necessities. (RELATED: More Than 700 People Died Overnight In Spain From Coronavirus) The restrictions sparked protests by hundreds of people who claim that locking down some parts of Madrid and not others is class-based discrimination by the government. The government said it enacted the restrictions in places with more than 1,000 cases per 100,000 residents, according to the report. A protester wearing protective masks holds a placard reading ‘Ayuso resignation. (Photo by Pablo Blazquez Dominguez/Getty Images) Spanish Prime Minister Pedro Sanchez said that the new lockdowns will not be as restrictive as they were in March. The health minister for the Czech Republic, Adam Vojtech, resigned Monday after new coronavirus cases hit a record high last week, the Associated Press reported. Epidemiologist Roman Prymula, who led the government’s coronavirus response in the spring, will take over the position, according to the report. Coronavirus restrictions were lifted earlier this summer, and new cases began to rise since then. Prymula said that restrictions were lifted too quickly. The Czech Republic, which has a population of 11 million people, has had 49,290 confirmed infections and 503 deaths, according to the report. Officials in the United Kingdom have also said that they are facing a rise in new cases. The infection rate “in a bad sense, literally turned a corner,” Chris Whitty, chief medical advisor to the U.K. government, said Monday according to CBS News. In many parts of England, new restrictions have been enacted limiting gatherings to 6 people and preventing socializing with other households, CBS News reported. More people have died in the United Kingdom from coronavirus than in any other European country. The country’s Health Secretary has said that a second lockdown has not been ruled out. The first lockdown was enforced by the police and prohibited public gatherings of more than 2 people, as well as closing non-essential businesses such as schools, bars, and restaurants. Germany saw the highest number of new daily infections since April, DW.com reported Saturday. At the peak of the pandemic in mid-March, the country was reporting around 6,000 new cases a day – Saturday, the Robert Koch Institute said that there had been 2,297 new cases in the past 24 hours. There have not been any new national lockdown orders imposed in Germany, but many cities towns have enacted their own restrictions, according to the report.

It creates lies and hurtful storyline. Stop feeding into it. Their friendship is definitely not what it was.” “And really, how can you have such a close friendship when one person is basically making a career out of the friendship?” the source added. In a video in June posted on Instagram, Exeter shared what she called a “generic call to action” in response to the Black Lives Matter movement. “Listen, I am by no means calling Jess a racist but what I will say is this: She is very well aware of her wealth, her perceived power and privilege because of the color of her skin.” “And that, my friends, gave her the momentary confidence to come for my livelihood in writing,” she added, sharing that Mulroney reportedly threatened her in an example of “textbook white privilege,” per People. Jessica then publicly apologized. But shortly after, the stylist’s show “I Do Redo” was taken off the air by the Canadian network CTV. Reports at the time claimed that the former “Suits” actress was distancing herself over the backlash, per Hello magazine.

RAFIZADEH: Accountability Is An Imperative Part Of Iran Policy

On Saturday, American officials announced that a full range of United Nations sanctions have returned on Iran, including a permanent extension of the arms embargo. Some observers debate the efficacy of these measures, particularly as European powers have signaled that they will not enforce them. But the efficacy argument is secondary to a much more significant dimension of Washington’s resolve — holding Tehran accountable for its current and future transgressions. It is remarkable that even during one of the most divisive election years in US history, this strategic principle has found vocal adherents on both sides of the aisle. For example, House Representative Brad Schneider, a Democrat from Illinois, has said, “We must always play a leadership role in holding the Iranian regime accountable for its misdeeds abroad and against their own people.” Similarly, Republican Senator Martha McSally has said, “The U.S. and the international community must continue to hold Iran accountable for its human rights violations and reprehensive behavior.” Both lawmakers were addressing an international summit on Iran policy Friday, which was organized by the main Iranian opposition National Council of Resistance of Iran (NCRI). It linked 10,000 locations worldwide virtually. Hundreds of bipartisan public officials and lawmakers from Europe, the US and Canada addressed the event formally called the Trans-Atlantic Summit on Iran Policy. Moderated by the internationally acclaimed television presenter Trish Regan, the event featured high-profile speakers such as Rudy Giuliani, Newt Gingrich, General James Jones, General Jack Keane and Senator Joe Lieberman. Nine sitting senators and 22 members of Congress also addressed the bipartisan event, including Senators Roy Blunt, Marco Rubio, Ted Cruz, Kirsten Gillibrand and Bob Menendez. The dozens of high-profile speakers called on world governments to hold Iran accountable for its reprehensible behavior. Regardless of the immediate material impact on the regime’s economic situation, accountability is a principle that undergirds a specific strategic calculus. Consider the facts. Recently, American intelligence officials reported that Tehran had developed plans to allegedly assassinate the US ambassador to South Africa in retaliation for the elimination of the terrorist mastermind Qassem Soleimani earlier this year. Meanwhile, according to the UN nuclear watchdog, Iran continues to increase its stockpile of enriched uranium in violation of the 2015 nuclear agreement. Tehran’s terrorist activity has also escalated, and if left unchecked such behavior could simply spiral out of control. In 2018, a senior Iranian diplomat stationed in Vienna was caught red-handed by European authorities hand delivering an explosive to a terrorist sleeper cell to bomb an opposition rally in Paris on June 30 of that year. At the gathering were hundreds of international personalities that took part in Friday’s Trans-Atlantic Summit, including the NCRI’s President-elect Maryam Rajavi. The detained diplomat, Assadollah Assadi, is scheduled to appear in a Belgian court in November. Unprecedented in Europe’s modern history, a sitting diplomat will be tried on charges of direct involvement in a terrorist plot. Over the past two years, seven Iranian diplomats, including an ambassador in Albania, have been expelled on similar charges. Against this backdrop, a profoundly consequential question arises for Iran policy. If the Europeans and Americans fail to show Tehran that its malign actions carry serious consequences, then what would stop the further escalation of such acts? If Tehran acts with impunity, it would be emboldened to try to impose itself on regional and international order.  That is why the Iranian people themselves are calling for accountability. Maryam Rajavi highlighted that “faced with executions and massacres, the people of Iran urge the United Nations, and the UN Security Council in particular, to restore snapback sanctions stipulated in the six UN resolutions against the clerical regime in Iran. Otherwise, [supreme leader Ali] Khamenei will continue to ravage the nation as his regime’s survival depends on murder and suppression.” Already, containing the regime’s regional meddling by eliminating Soleimani has yielded historic results. As former national security advisor James Jones told the Trans-Atlantic Summit, the UAE and Bahrain agreements with Israel show that “the circle of countries that are in direct opposition to what Iran is doing is growing by leaps and bounds.” Now, the United States and European countries must pressure the UN General Assembly and Security Council to take on the Iranian regime’s atrocious human rights record. There is very little to disagree with Republican Senator Rubio’s statement that the objective should not simply be to keep Iran from obtaining nuclear weapons or supporting terrorism. It should also be “to give Iran back to its people.” That is the ultimate strategic solution to the crisis. And again, there is remarkable bipartisan agreement on supporting the people and the opposition. As the most senior Democratic senator in the Foreign Relations Committee, Bob Menendez, said at the gathering, “While in Congress we may have differing approaches about the best way to address the threat from Iran, rest assured that we remain united against the regime’s fundamental abuses against its citizens.” Dr. Majid Rafizadeh is a business strategist, Harvard -educated scholar, board member of Harvard International Review, an Iranian-American political scientist and president of the International American Council.

Whoopi Goldberg had to put the brakes on a Monday segment of “The View” as the discussion turned to possible replacements for late Supreme Court Justice Ruth Bader Ginsburg. The show’s hosts began with their individual memories of Ginsburg, as well as how she had shaped the court and impacted their lives. The conversation then turned to Senate Majority Leader Mitch McConnell’s plan to go ahead with a vote on President Donald Trump’s promised nomination. (RELATED: ‘I Was Completely Radicalized’: Meghan McCain Says Kavanaugh Hearings ‘Changed The Game’) WATCH: Sara Haines began with a clip of Republicans explaining in 2016 — when McConnell denied a hearing to then-President Barack Obama’s nominee Merrick Garland — why an election-year vacancy should not be rushed. “So I hear a lot of these politicians referring to the people that put them in office, and the people should be heard,” Haines said. “Well, they would be heard on November 3.” Haines went on to say that, especially in the context of the coronavirus pandemic and the fact that many American families were still really feeling the impact of both the virus and the economic fallout, Congress should be focused on things other than Supreme Court confirmation hearings. “In the shadow of what’s been left behind after Ruth Bader Ginsburg’s passing, the irony of what type of human she was and what we’re seeing in our politicians is disheartening,” Haines concluded. “But at the same time, you have people on the left that are screaming that they’re going to pack courts and create violence and you’re going to see chaos that we’ve never seen if Mitch McConnell does this,” Meghan McCain pushed back. “Everyone is behaving badly across the board.” McCain went on to say that 47% of Americans identify as pro-life, and she felt that might drive some of them to the polls if the possibility of another conservative justice were hanging in the balance. “For people that are pro-life, not never-Trumpers who got rid of their policies and every principle they ever had, for people like me, it is a meat and potatoes issue, much like guns. It will get people out, period,” she said. “I’m saying —” Joy Behar interrupted. “One thing that just —” Haines cut in as well. “Okay,” Goldberg tried to rein things in, but several of her co-hosts kept talking. “Without slandering some of the names we’re seeing, judge Amy Coney Barrett said something that should scare all of us,” Haines said. “‘A legal career is but a means to an end —’” “I would be very careful slandering her, Sara,” McCain shot back. “Before she’s even —” “I’m not,” Haines protested. “No —” “This is what I’m talking about with the Kavanaugh stuff,” McCain explained. “Meghan, please just give me —” Haines tried again, and the two continued to shout over each other until Goldberg clapped her hands together. “Everybody, stop!” she said, drawing the segment to a close.

Kentucky Republican Lawmaker Indicted For Allegedly Threatening To ‘Hog Tie’ A Woman With Ethernet Cable

Kentucky Republican state Rep. Robert Goforth was indicted Friday for allegedly strangling a woman her with an ethernet cable, almost stopping her from breathing, and threatening to “hog-tie” her. Goforth, who was once a candidate for governor, was indicted by a grand jury in Laurel County, Kentucky on one count of first-degree strangulation and one count of assault in the fourth degree, according to The Washington Post. In April, Goforth reportedly got in a fight with the woman whose three young children were still inside the home, leaving her with bruises on her leg and marks on her neck and arms, according to the Corbin Times-Tribune The fight was reportedly over her unlocking her phone, to which Goforth then allegedly grabbed an ethernet cable and began strangling her to the point where she “had difficulty breathing and thought she was going to pass out,” the police report said. The woman then showed up at the 911 dispatch center explaining what had allegedly happened to her. (Screen-Shot_Youtube_Robert-Goforth-Concession-Speech-2019-Primary-Election-Kentucky-Educational) The only way she was able to leave the house was reportedly after she promised Goforth she would unlock her phone for him. Goforth reportedly did not seem to be under the influence of drugs or alcohol when he was arrested, The Laurel County Sheriff’s Office said. (RELATED: Democratic Kansas House Candidate Admits To Abusing Ex-Girlfriend — Says ‘Medicaid For All’ Could Have Stopped Him) Goforth has yet to resign from his seat in the state House, despite the indictment. He also reportedly faced sexual allegations during his last campaign, according to The Post. He was first elected to serve in Kentucky’s 89th House district in 2018. (RELATED: Democratic Mayoral Candidate Sabrina Belcher Faked Her Own Kidnapping To Win Votes, Police Say) Goforth’s Democratic challenger Mike VanWinkle and other Kentucky Democrats have called for him to drop out of the race. “This district has suffered enough embarrassment and bad press over this affair,” VanWinkle said in a Facebook post Friday. “Mr. Goforth needs to remain focused on his legal case, Domestic Violence issues, and marriage.”

Trump Signs Executive Order Reinstating Pre-Nuke Deal Iran Sanctions Despite UN Objections — Adds 27 New Targeted Bodies To Sanctions List

President Donald Trump signed an executive order Monday that will attempt to reinstate sanctions placed on Iran prior to the signing of the Joint Comprehensive Plan Plan of Action (JCPOA) and place new sanctions and other control measures to 27 additional groups and individuals over their roles in advancing Iran’s weapons systems.“This Executive Order is critical to enforcing the UN arms embargo on Iran,” Trump claimed in a statement issued by the White House press office. “The order will greatly diminish the Iranian regime’s capacity to export arms to terrorists and dangerous actors throughout the region, as well as its ability to acquire weapons to build up its own forces.” “My actions today send a clear message to the Iranian regime and those in the international community who refuse to stand up to Iran.  The United States will not allow the Iranian regime to further advance capabilities to directly threaten and terrorize the rest of the world,” the president continued. “My Administration will use every tool at our disposal to stop Iran’s nuclear, ballistic missile, and conventional weapons pursuits.” (RELATED: Trump Formally Orders Iran Nuclear Deal ‘Snapback’ — Instructs Pompeo To Ask UN To Restore All Sanctions) He further challenged the Iranian regime to “change its behavior if it hopes to provide what the Iranian people so desperately want and deserve: a thriving and prosperous Iran.” WASHINGTON, DC – SEPTEMBER 19: U.S. President Donald Trump walks to speak to members of the press prior to his departure from the White House on September 19, 2020 in Washington, DC. Security Council claimed the U.S. did not have the authority to unilaterally reinstate the sanctions. The White House had not released the text of the order by press time.

Joe Biden Told Voters The Second Amendment Does Not Protect An Individual Right

During a September 2019 “townhall” hosted by New Hampshire ABC affiliate WMUR, Democratic presidential candidate Joe Biden made clear that he does not believe the Second Amendment protects an individual right to keep and bear arms and that the U.S. Supreme Court decision in District of Columbia v. Heller was incorrect.During the event, Biden was asked, “Do you agree with the D.C. v. Heller decision in regards to protecting the individual right to bear arms that are in common use and which are utilized for lawful purposes?” Biden responded in part, “If I were on the court I wouldn’t have made the same ruling. OK, that’s number one.” Later, the noted resume padder and law school plagiarist boasted, And I taught for years Constitutional law and separation of powers, I taught the Second Amendment. And the Second Amendment is not absolute. And we can argue, the fundamental argument is well regulated militia and all those things, I won’t get into that. I think that the fundamental argument is the reason that was given as a right because we needed to be able to muster people to deal with an enemy called Great Britain we were fighting in a war. Aside from his denunciation of Heller and denial that the Second Amendment protects an individual right to keep and bear arms, Biden also displayed a fundamental misunderstanding of the Bill of Rights. The Second Amendment was not “given as a right” by the U.S. Constitution. Rather, as the U.S. Supreme Court made clear in Heller, the Second Amendment protects a right that pre-existed the U.S. Constitution and Bill of Rights. Biden’s position on Heller and the Second Amendment is in line with that of his running mate Sen. Kamala Harris (D-Calif.). As District Attorney of San Francisco, Harris signed on to an amicus curiae brief in Heller that argued the Second Amendment does not protect an individual right to keep and bear arms. Advocating against the individual right to keep and bear arms, the brief argued, courts have consistently sustained criminal firearms laws against Second Amendment challenges by holding that, inter alia, (i) the Second Amendment provides only a militia-related right to bear arms, (ii) the Second Amendment does not apply to legislation passed by state or local governments, According to the document, the Second Amendment does not protect an individual right, but rather, the lower court in Heller “create[d]”this right. The brief stated, The lower court’s decision, however, creates a broad private right to possess any firearm that is a “lineal descendant” of a founding era weapon and that is in “common use” with a “military application” today. Biden’s position on the Second Amendment is also in alignment with recent versions of the Democratic Party Platform. The 2004, 2008, and 2012 editions of the party platform recognized that the Second Amendment protects an individual right. Such recognition of the Second Amendment was conspicuously absent from the 2016 and 2020 versions of the platform. The Democratic presidential ticket’s rejection of the correct interpretation of the Second Amendment helps to explain the pair’s advocacy for blatantly unconstitutional gun control measures. Both Biden and Harris have called to ban and confiscate commonly-owned semi-automatic firearms. Biden has made clear that his desired ban would extend to arguably the most popular firearms in America – 9mm pistols. The Heller decision made clear that the Second Amendment protects the right to own firearms “in common use”for lawful purposes like self-defense. It is hard to overemphasize the extremism of the Democratic presidential ticket’s position on the Second Amendment. A February 2008 USA Today/Gallup poll conducted prior to the Heller decision, asked those surveyed, “Do you believe the Second Amendment to the U.S. Constitution guarantees the rights of Americans to own guns, or do you believe it only guarantees members of state militias such as National Guard units the right to own guns?”The response was unambiguous; 73-percent responded that the Second Amendment guarantees the rights of Americans to own guns, while a mere 20-percent limited that right to state militia members. A Quinnipiac University poll conducted shortly after the Heller decision, in July 2008, mirrored these results. This poll asked respondents, “Would you support or oppose amending the United States Constitution to ban individual gun ownership?”78-percent opposed such a measure, while only 17-percent were found to be in favor. And in May 2009, CNN and ORC conducted a similar poll that asked “Which of the following comes closer to your interpretation of the Second Amendment to the U.S. Constitution? In addition to addressing the need for citizen-militias, it was intended to give individual Americans the right to keep and bear arms for their own defense. It was only intended to preserve the existence of citizen-militias, and does not give individual Americans the right to keep and bear arms for their own defense.”Once again, the American public made their position clear; with 77-percent choosing “individual gun ownership”to 21-percent answering “only citizen-militias.” Knowing that Biden’s true position on the Second Amendment is political poison, the Biden campaign and its surrogates have done their best to hide the candidate’s views. In March, when a pro-gun Michigan autoworker accurately confronted Biden about the candidate’s attacks on the Second Amendment, a visibly defensive Biden responded that the worker was “full of s***.”Biden went on to falsely claim “I support the Second Amendment.” More recently, longtime gun control activist John Rosenthal made the ludicrous claim that “a vote for Joe Biden and Democrats in Congress will…protect gun rights for law-abiding gun owners…”Rosenthal didn’t address how Biden will go about protecting a right that the candidate does not acknowledge exists. The importance of Biden’s radical view of the Second Amendment cannot be overstated. The fate of the Second Amendment literally hangs in the balance of this election. Established in 1975, the Institute for Legislative Action (ILA) is the “lobbying” arm of the National Rifle Association of America. ILA is responsible for preserving the right of all law-abiding individuals in the legislative, political, and legal arenas, to purchase, possess and use firearms for legitimate purposes as guaranteed by the Second Amendment to the U.S. Constitution. Click here to follow NRA-ILA on Facebook.

Archaeologists Discover 27 Sarcophagi In Egypt That Have Remained Unopened For 2,500 Years

Archaeologists have discovered 37 ancient coffins in Egypt that are believed to have remained unopened since they were buried around 2,500 years ago, numerous sources reported. The coffins, also called sarcophagi, were buried near the Step Pyramid of Djoser in Saqqara, which is located 20 miles south of Cairo and is a designated UNESCO World Heritage Site. A spokesperson for Egypt’s Ministry of Tourism and Antiquities said 12 coffins were found earlier in September in a newly discovered well, and were followed by the unearthing of 14 more in another well, the Associated Press reported. (Photo by CHRISTOPHE SIMON/AFP via Getty Images) Although the sarcophagi have been underground for millennia, they retained their original colors, and are seen covered in color and ancient Egyptian hieroglyphics in footage shared by the ministry, the AP reported. Additional, smaller artifacts were also discovered in the burial shaft, which stretched 30 feet below ground. Among the artifacts was a figurine typically buried in Egyptian gravesites to aid the deceased in the afterlife, CNN reported. A picture taken on May 13, 2017, shows mummies lying in catacombs following their discovery in the Touna el-Gabal district of the Minya province, in central Egypt.(KHALED DESOUKI/AFP via Getty Images) The ministry had previously announced discoveries at the site as being “the largest number of coffins in one burial since the discovery of the Al-Asasif cachette,” according to CNN. In 2019, 30 coffins with mummies inside were unearthed and were determined to have been Egypt’s largest find in over a century at the time. Among the discoveries made in 2019 were hundreds of mummified animals, birds, and crocodiles, as well as two mummified lion cubs. A year prior, archaeologists unveiled the nearly 4,400-year-old tomb of the “divine inspector” from Egypt’s fifth dynasty. President Donald Trump appeared to push back his timeline for announcing a new Supreme Court Justice nominee, citing memorial services for Justice Ruth Bader Ginsburg. Ginsburg died Friday at age 87 due to complications from metastatic pancreatic cancer. Trump told reporters Saturday that he plans to announce a Supreme Court nominee “next week,” adding that it will “most likely” be a woman. White House press secretary Kayleigh McEnany first told “CBS This Morning” that the president “very likely” could announce a nominee before Wednesday. Trump appeared to push this timeline back while talking to “Fox & Friends” Monday morning. Ginsburg’s death opens up the possibility for Republicans to shift power within the Supreme Court, Fox News reported. Republican Senate Majority Leader Mitch McConnell’s home was the site of an early morning protest Monday after he announced that Trump’s nominee would be voted on by the Senate.

‘I Made A Mistake’: New Zealand Prime Minister Apologizes For Taking Selfie Without A Mask

New Zealand’s Prime Minister has apologized for taking a selfie without a mask on, calling it a “mistake.”“In that particular photo I made a mistake,” Prime Minister Jacinda Ardern said at a press conference Monday, according to the New Zealand Herald. “Yes I should have moved further forwards and I should have asked them to step apart as well.” “It is hard,” she added. “I will keep up, as I have, those awkward moments where I refuse to shake hands.” (RELATED: Four New COVID-19 Cases Hurl New Zealand Into Renewed Country-Wide Lockdown) In the photo, Arden was pictured with a group of supporters. She has so much more time. The other major takeaway from the award show was that “Schitt’s Creek” was obviously the best thing to ever be given to us. The TV show created by Dan Levy took home seven awards Sunday night bringing the total number of Emmys to nine. I pretty much am very satisfied with the way the Emmys played out. ‘I Was Completely Radicalized’: Meghan McCain Says Kavanaugh Hearings ‘Changed The Game’ For Republicans

Meghan McCain said Monday that Supreme Court Justice Brett Kavanaugh’s confirmation hearings had “changed the game” for many Republicans.McCain added that she herself had been “completely radicalized” by Kavanaugh’s 2018 testimony, saying that she believed it would color the way a lot of Republicans saw the next confirmation battle. And that battle, to fill the seat vacated when Justice Ruth Bader Ginsburg passed away last Friday, could unfold even as the November election approaches. (RELATED: ‘It Wasn’t Just President Trump’: Meghan McCain Says People Don’t Trust Coronavirus ‘Experts’ Because They Lied Too) WATCH: McCain began by saying that a quick confirmation had really only been made possible by former Senate Majority Leader Harry Reid when he scrapped the judicial filibuster and argued that the potential for contested election results made the possibility of a split 4-4 court even more problematic. McCain then pivoted to McConnell, who denied a hearing to former President Obama’s nominee Merrick Garland in 2016, saying that she understood why her cohosts on “The View” and other critics would call him a hypocrite for choosing to move forward to fill Ginsburg’s seat. “I hear what you guys are saying about hypocrisy, and I hear it and receive it, but he is someone that — he only cares about this. This is, like, his core issue. He does not want to run for president. He doesn’t want to seek higher office, and if everybody doesn’t think he has been preparing for this exact scenario, they’re just a little naive,” she explained. “I honestly think, because I have been talking about this all weekend, that Kavanaugh really changed the game for a lot of Republicans, myself included,” McCain continued. “I was completely radicalized by the experience of watching him testify. I mean, there were accusations of him being someone who was part of a gang-rape gang, and accusations that were completely baseless, and it has shown that Democrats on their side will do anything and everything to smear any conservative.” McCain went on to mention Judge Amy Coney Barrett, one of the women considered to be a frontrunner for the nomination, and predicted that it was only a matter of time before the ugly attacks against her began to fly. “My last and final point is this has turned the election back into battleground core meat and potato issues and if you are pro-life, like I am and 47% of the country is, it becomes a reason for you to support President Trump if you were someone that was wavering,” McCain concluded.

‘Sunday Night Football’ Viewership Declines 17% In The Early Ratings From Week 1

The Seattle Seahawks beating the New England Patriots on “Sunday Night Football” didn’t get great TV ratings. According to Deadline, the early ratings are not impressive for “SNF” and the audience was only 12.22 million viewers on NBC. (RELATED: David Hookstead Is The True King In The North When It Comes To College Football) That’s a 17% decline from Week 1. Now, the final numbers will almost certainly rise a little bit, but it’s still not pretty. Well, this certainly isn’t a great look for the NFL at all. While it’s impossible to say one single thing has caused a decline, I have a feeling we all know one issue that has played a major role. People hate how political pro sports have become. It’s just the truth. The average fan wants to kick back and enjoy the game. That’s just the reality of the situation. It no longer feels like the NFL is about winning and losing games. It feels like it’s about lecturing fans around the clock. Average Americans don’t want to be lectured by millionaire athletes. They just don’t! Welcome to reality, my friends! Hopefully, the NFL opens their eyes to what the fans and consumers want. If not, these ratings might not get better for a long time.

H.R. McMaster: Some WH Advisers ‘Cast Themselves In The Role Of Saving The Country And Maybe The World From Trump’

Former National Security Adviser H.R. McMaster said Sunday that there were some White House advisers who believed their job was to save the world from President Donald Trump.McMaster explained that when he joined CBS’ Scott Pelley to discuss his new book, “Battlegrounds,” on “60 Minutes.” (RELATED: McMaster Calls National Security Leaks To The Media ‘Treasonous’) WATCH: Pelley introduced McMaster, a three-star general who claims no allegiance to either political party, saying, “He told us the last few presidents, not just President Trump, have left the United States vulnerable in the eyes of those who would do us harm. How do our competitors view the United States today?” McMaster said that competitors — specifically China and Russia — likely see the United States as “weak and divided.” “I think they see an opportunity. I think China thinks it’s winning. You know, China sees an America that is divided against each other,” McMaster said, citing what he called the “triple crisis of Covid-19” — the spread of the virus, the subsequent recession and the civil unrest that followed the death of George Floyd. “And so, China is acting, I think, now much more aggressively because they think it’s time to do it. They have a window of opportunity to exploit our weaknesses and to come after us. I think Russia feels the same way. I think other adversaries could feel the same way,” McMaster explained. “The very first line in your book is, ‘This is not the book that most people wanted me to write,’” Pelley prompted then. “Right. People wanted me to write another tell-all about my time in the Trump Administration,” McMaster said. “People wanted me to write another book about palace intrigue. I think what Americans need today is we need— we need— a discussion— a meaningful, a respectful discussion about these very serious challenges to our security, our prosperity and our influence in the world.” McMaster went on to say that while he got a wide range of advice from friends and family members — both for and against — when he was asked to serve in the Trump administration, he found the decision to be an easy one. Pelley went on to ask McMaster what he thought about rivalries within the West Wing, and the former National Security Adviser explained that he believed there were several different agendas in play. “There is certainly one group of people there who are there to serve the elected president and to serve the country,” he said. “I think there are other groups there though, as well, a second group that is there really, instead of providing options to the elected president, they really want to advance their narrow agendas. And then I think there’s a third group, and I think this is true probably of any administration, who cast themselves in the role of saving the country and maybe the world from the president.” “Were you trying to save the world from the president?” Pelley asked. “No. It was my duty to help the president come to his own decisions,” McMaster replied.

You Betcha recently released an incredible video about fantasy football. The popular entertainment company released “5 Types of Fantasy Owners,” and this one is laugh-out-loud funny. It’s probably one of You Betcha’s better videos in the past month. (RELATED: David Hookstead Is The True King In The North When It Comes To College Football) Give it a watch below. It’s hilarious. [embedded content] As I often say with You Betcha, it’s almost scary how accurate these videos are. They always hit the nail right on the head without fail. It’s incredibly impressive. No matter what the subject matter is, You Betcha always shows up and shows out. [embedded content] As a guy who plays fantasy football, I can promise you that the video above is about as accurate as it gets when it comes to the kind of guys who play. Honestly, I’m not even sure which one of those guys I am when it comes to fantasy football. Probably the last guy. I’m always second guessing my roster when things go poorly. Let us know in the comments which one you were, and as always, props to You Betcha for giving us something to laugh about.

KIRK: If Illegal Immigrants Could Vote, They Would Back Joe Biden

A Joe Biden presidency would be a dream come true for millions of illegal immigrants — and a nightmare for hard working American citizens who expect to receive the benefits they’ve been paying for their entire lives. For almost half a century, the Democrat nominee has consistently failed to empower American workers or protect the blue collar jobs that sustain our middle class. As a senator, Biden repeatedly attempted to cut vital government programs that taxpayers have been paying into for their entire working lives, including Social Security, Medicare, and Medicaid. Instead of eliminating the bloated and wasteful pork projects such as the infamous “Bridge to Nowhere” (which Biden supported), Biden would have hurt millions of working families that had been promised a social safety net that their tax dollars paid for to begin with — in essence, reneging on a sacred contract between the American people and our federal government. “When I argued that we should freeze federal spending, I meant Social Security as well,” he admitted in 1995. “I meant Medicare and Medicaid. I meant veterans’ benefits. I meant every single solitary thing in the government. And I not only tried it once, I tried it twice, I tried it a third time, and I tried it a fourth time.” As important as it is to rein in federal spending and reduce the national debt, an across-the-board spending freeze is a particularly lazy way to go about it, especially when it hurts hard working American families who form the backbone of our communities. Biden’s approach would have only perpetuated unnecessary programs while constraining those that are actually beneficial to the American people. Just another in a very long line of poor policy proposals by the former vice president. Around the same time, Biden was also promoting disastrous one-sided trade deals that have done lasting damage to the U.S. economy, including the infamous North American Free Trade Agreement (NAFTA), which cost our country millions of high-quality blue collar jobs. “I’m supporting NAFTA because I think it is a positive thing to do but not because I think it is going to cure the workers’ fears who have a legitimate reason to be concerned,” he explained in 1993, openly acknowledging that he knew the agreement would prove to be a complete calamity for American producers and the millions of workers they employ. While Biden has a long history of giving foreign workers an unfair advantage over Americans, his current immigration agenda would go much further, forcing Americans to compete with foreigners for jobs right here in our own country. If the former vice president manages to win the presidency this November, he has promised to implement de facto open-borders policies, including a push to reward illegal aliens with citizenship and provide them with “free” taxpayer-funded health care. “Democrats believe it is long past time to provide a roadmap to citizenship for the millions of undocumented workers, caregivers, students, and children who are an essential part of our economy and of the fabric of our nation,” the official 2020 Democrat Party platform states. To make matters worse, Biden and his Democrat colleagues have repeatedly vowed to repeal President Trump’s border security initiatives, despite the fact that they have demonstrably helped to keep our communities safe from international human traffickers, violent gang members, and drug smugglers. “There will not be another foot of wall constructed on my administration,” Biden declared last month. The Democrat platform also pledges to “eliminate unfair barriers to naturalization, reduce application backlogs, and make our immigration processes faster, more efficient, and less costly” — which is another way of saying that the party seeks to make it easier for illegal immigrants to obtain legal status and compete for American jobs more easily. If illegal immigrants could vote, they would certainly back Joe Biden at the ballot box this November. American workers, on the other hand, can’t afford to elect a politician who will stab them in the back on his first day in office. COVID-19 Can Travel More Than 6 Feet In Air, According To New CDC Guidelines

The Centers for Disease Control and Prevention (CDC) changed its guidance regarding coronavirus transmission Friday, saying the virus can travel “beyond 6 feet” through the air.“It is possible that COVID-19 may spread through the droplets and airborne particles that are formed when a person who has COVID-19 coughs, sneezes, sings, talks, or breathes,” the updated guidelines read. “There is growing evidence that droplets and airborne particles can remain suspended in the air and be breathed in by others, and travel distances beyond 6 feet (for example, during choir practice, in restaurants, or in fitness classes).” The CDC also warned that “indoor environments without good ventilation” increases the risk of contracting the virus. The agency said inhaling the particles is the primary mode of transmission. “These particles can be inhaled into the nose, mouth, airways, and lungs and cause infection. This is thought to be the main way the virus spreads.” Footprints are marked for safety distancing in front of a restaurant during the coronavirus pandemic, September 18, 2020, in Los Angeles California. (Photo by VALERIE MACON / AFP) (Photo by VALERIE MACON/AFP via Getty Images) The CDC previously said social distancing of 6 feet was a good way to avoid the virus, according to CNN. The guidelines now recommend staying “at least 6 feet away from others, whenever possible.” The guidance also changed the language regarding asymptomatic transmission. Originally the guidelines said “some people without symptoms may be able to spread the virus,” according to CNN. However the guidelines now say “people who are infected but do not show symptoms can spread the virus to others.” In July, the journal of Clinical Infectious Diseases published a letter from more than 200 scientists urging the World Health Organization (WHO) to address the fact that the virus can spread through droplets floating in the air. “There is significant potential for inhalation exposure to viruses in microscopic respiratory droplets (micro droplets) at short to medium distances (up to several meters, or room scale),” the letter read. (RELATED: Study Finds That Full Lockdowns Did Not Reduce Coronavirus Mortality Rate) The letter said that “viruses are released during exhalation, talking, and coughing in microdroplets small enough to remain aloft in air and pose a risk of exposure at distances beyond 1-2m [3-6 feet] from an infected individual.” “Most public health organizations, including the World Health Organization, do not recognize airborne transmission except for aerosol-generating procedures performed in healthcare settings. Hand washing and social distancing are appropriate but, in our view, insufficient to provide protection from virus-carrying respiratory micro droplets released into the air by infected people.” The WHO issued a report following the letter saying the coronavirus can possibly pass through air in crowded indoor spaces.

CDC Says New COVID-19 Guidelines That Said Virus Can Travel More Than 6 Feet In Air Were Accidentally Updated

The Centers for Disease Control and Prevention (CDC) said Monday they erroneously updated their COVID-19 guidelines Friday that said the virus can travel “beyond 6 feet” through the air.“A draft version of proposed changes to these recommendations was posted in error to the agency’s official website,” the CDC said Monday, according to CNBC. “CDC is currently updating its recommendations regarding airborne transmission of SARS-CoV-2 (the virus that causes COVID-19). Once this process has been completed, the update language will be posted.” The World Health Organization (WHO) said they contacted the CDC about the change in guidance, per the same report. The WHO said they have not seen any “new evidence” on airborne particles and was checking with the CDC to “better understand” the new changes. The CDC had originally updated their COVID-19 guidelines Friday, warning that the virus can spread farther than originally thought. “It is possible that COVID-19 may spread through the droplets and airborne particles that are formed when a person who has COVID-19 coughs, sneezes, sings, talks, or breathes,” the updated guidelines read. Trump Mocks MSNBC’s Ali Velshi After Reporter Says He Got Hit With Rubber Bullet

President Donald Trump mocked the moment MSNBC’s Ali Velshi said he got hit with a rubber bullet while reporting live in Minnesota in May.Trump made the comments Friday during a political rally in Bemidji while discussing the mass unrest that has occurred around America since the death of George Floyd in May. The president brought up Velshi during the speech, saying that “he got hit in the knee with a canister of tear gas and he went down.” “I remember this guy Velshi,” Trump said. “He got hit in the knee with a canister of tear gas and he went down. He was down. ‘My knee, my knee.’ Nobody cared, these guys [police] didn’t care, they moved him aside.” “And they just walked right through. It was the most beautiful thing,” Trump continued. “No, because after we take all that crap for weeks and weeks, we take this crap, and then you finally see men get up there and go right through … wasn’t it really a beautiful sight? It’s called law and order. Law and order.” WATCH: Velshi replied on Twitter and pushed back on Trump’s comments, saying that he got hit with a rubber bullet and not a tear gas canister. The MSNBC journalist also said he was “covering an entirely peaceful … march.” (RELATED: ‘This Is Mostly A Protest’: MSNBC’s Ali Velshi Says Riots Aren’t Unruly As Building Burns Behind Him) So, @realDonaldTrump, you call my getting hit by authorities in Minneapolis on 5/30/20 (by a rubber bullet, btw, not a tear gas cannister) a “beautiful thing” called “law and order”. What law did I break while covering an entirely peaceful (yes, entirely peaceful) march? — Ali Velshi (@AliVelshi) September 19, 2020 MSNBC pushed back on Trump’s comments as well, condemning him for mocking a reporter’s injury. “Freedom of the press is a pillar of our democracy,” an MSNBC spokesperson said according to CNN. “When the President mocks a journalist for the injury he sustained while putting himself in harm’s way to inform the public, he endangers thousands of other journalists and undermines our freedoms.” Velshi and his camera crew were fired upon by police officers during a live daytime covering of Minneapolis protests in May, CNN reported. Velshi said during the protest that “there has been no provocation … the police pulled into this intersection, unprovoked” and “started firing in both directions.” “They now have fired at us,” he added according to CNN. Trump campaign spokesman Tim Murtaugh said that the president was not referring to Velshi when he said “it was the most beautiful thing,” CNN reported. Trump made the comments in regards to “the restoration of peace,” Murtaugh said.

‘Permitting Anarchy, Violence’: DOJ Finds New York, Portland, And Seattle In Violation Of Trump’s Memorandum

New York City, Seattle and Portland, Oregon have allowed ongoing violence and destruction of property and refused to institute measures to prevent criminal activity, the Department of Justice (DOJ) said Monday. These cities met the criteria President Donald Trump issued on Sept. 2 to identify cities that have not sufficiently dealt with rioters and would be subject to funding review, the DOJ announced. “When state and local leaders impede their own law enforcement officers and agencies from doing their jobs, it endangers innocent citizens who deserve to be protected, including those who are trying to peacefully assemble and protest,” Attorney General William Barr said, according to the DOJ. “We cannot allow federal tax dollars to be wasted when the safety of the citizenry hangs in the balance,” Barr added, according to the DOJ. “It is my hope that the cities identified by the Department of Justice today will reverse course and become serious about performing the basic function of government and start protecting their own citizens.” Department of Justice Identifies New York City, Portland and Seattle as Jurisdictions Permitting Violence and Destruction of Property https://t.co/CvqKwNIQTw — Justice Department (@TheJusticeDept) September 21, 2020 In New York City, shootings increased after protests and looting started around May 28, while New York City Council voted to cut the New York Police Department budget by $1 billion, according to the DOJ. Protests continued in Portland, Oregon, for 100 consecutive nights where rioters started fires, destroyed property, and injured numerous officers, according to the DOJ. The Portland City Council voted to cut $15 million from the police bureau, a move that included eliminating the law enforcement team that investigates shootings, though the city has seen an increase in shootings. In Seattle, Washington, “anarchists and activists” established the “Capitol Hill Autonomous Zone” (CHAZ) which turned in to the “Capitol Hill Occupied Protest” (CHOP) where law enforcement and other emergency first responders were not permitted to enter in June, according to the DOJ. (RELATED: Seattle Rioters Tried To Seal Police Precinct Door Before They Allegedly Lit A Fire Outside, Police Guild Says) During the month CHOP existed, crime in the area increased 525% from the previous year, including “two additional homicides, 6 additional robberies, and 16 additional aggravated assaults (to include 2 additional non-fatal shootings),” according to the DOJ. ‘A Crisis In The Making’: Betsy DeVos Says Without Federal Aid, Many Private Schools Are Close To Closing

Many private schools are on the verge of shutting down if they don’t receive federal coronavirus relief, Education Secretary Betsy DeVos told Fox News on Sunday.DeVos asked Congress for coronavirus relief that would help school choice and said that private schools are close to closing if they do not receive the assistance, according to Fox News. (RELATED: Federal Judge Blocks Betsy DeVos Rule On Private School COVID Funds) “We need to have immediate relief for those schools,” DeVos told Fox News. “Think about the impact of all of these kids who suddenly now are showing up at the traditional public school door because they no longer have this other option. That’s a crisis in the making right there,” DeVos said. At least 160 private schools have closed in 2020 for good because of the economic struggles from the coronavirus, according to Fox News. Since tax revenue is gone and there hasn’t been relief assistance from Congress, public schools are also seeing challenges from economic struggles and teachers are also being laid off, Fox News reports. Education Secretary Betsy Devos (REUTERS/Kevin Lamarque) DeVos told Fox News about the wave of private school closings, including many Catholic schools, while she spoke about how coronavirus relief for school choice could help some types of faith-based schools. “It would have an immediate impact, first of all, for those kids in those schools that are at risk of closing,” DeVos said, according to Fox News. “If they don’t get additional resources or students able to enroll and bring the tuition, there are more that are at risk of closing,” DeVos told Fox News. DeVos said that a lot of “major urban areas have not reopened in person,” adding that her “greatest fear is for the kids who are the most vulnerable — for the ones whose parents don’t have the financial resources to do something different. They’re the ones who always get the short end of the straw.” “That is not right,” DeVos said. “It is unjust, and it’s something that I have been fighting for more than 30 years, which is exactly why we need to give the parents the resources … [to] decide what is best for them and their kids,” she continued. The Department of Education did not immediately respond to the Daily Caller News Foundation’s request for further comment. With $466 Million On Hand, Joe Biden Launches Ads Hoping To Flip Iowa And Georgia

Democratic presidential nominee Joe Biden is launching ads in Iowa and Georgia, two states that President Donald Trump won in 2016.The latest ad buys bring Biden’s digital battleground map to 12 states, 10 of which Trump won four years ago, and reflects his campaign’s pledge to establish “multiple paths” to winning 270 electoral votes, the Associated Press reported. Biden’s campaign announced Sunday that it had $466 million on hand at the beginning of September. The announcement followed a $365 million August fundraising total. Both Trump’s campaign and the Republican party announced that it had $325 million on hand at the beginning of September, AP reported. Biden’s campaign has also placed ad buys in Wisconsin, Michigan, Pennsylvania, Ohio, North Carolina, Florida, Arizona and Nebraska, all of which Trump won in 2016. The campaign has also spent money in Nevada and Minnesota, two states that Hillary Clinton won four years ago but that the Trump campaign looks to flip in November. From January 2019 through August 2020, Trump spent $240 million on ads compared to Biden’s $165 million, but Biden has committed $210 million towards ads between September and the election, compared to just under $170 million for Trump, according to spending data reported by AP. Biden has also outspent Trump in Florida and Pennsylvania, according to CNN. “Florida and Pennsylvania are two of the biggest prizes for either candidate and probably must-wins for both Trump and Biden,” CNN contributor Nathan Gonzales told the outlet. “It’s hard to replace 29 or 20 electoral votes with another state.” Biden is slightly favored to win both states, according to FiveThirtyEight. ‘The Wire’ Will Forever Be Remembered As 1 Of The Greatest TV Shows Ever Made

I finally finished “The Wire,” and it was an incredible journey. As many of you reading this know, I’ve been crushing episodes of the classic HBO crime show about the drug trade in Baltimore. (REVIEW: ‘Westworld’ Season 3 Ends With The Possible Deaths Of Multiple Characters) [embedded content] Despite the fact the show premiered nearly two decades ago, I was incredibly late to the party. However, that hasn’t stopped me from loving it. [embedded content] I finished the fifth and final season over the weekend, and I can say with supreme confidence that “The Wire” will go down as one of the greatest shows ever made. The writing, acting, storylines and everything else involved with “The Wire” is incredibly impressive and next level. [embedded content] It also feels so real. All the characters have good and bad qualities. I know that’s kind of a cliche thing to say, and most of the time it is. However, not when we’re talking about “The Wire.” Even the bad guys you find yourself cheering for because you empathize with them. [embedded content] Obviously, whether it’s Bodie or Omar, you can’t help but feel attached to people in the drug game. When Bodie died in season four, I was 100% shook. I won’t tell you Omar’s fate, but it was the same. “The Wire” also reminds us that there aren’t always happy endings and the bad guys don’t always lose. In fact, the bad guys win all the time in the real world, and the series finale is a blunt reminder of that fact. [embedded content] If you haven’t seen “The Wire” yet, I can’t suggest it enough. I should have watched it years ago, but I’m glad I finally did. It was amazing from start to finish.

Hawaii: Gun Control Bills Become Law

Last week was the deadline for Governor Ige to sign or veto legislation on his desk. Governor Ige signed SB 3054, and HB 2744 went into law without his signature, due to his failure to veto the measure. Both bills are effective upon approval and are now state law. House Bill 2744 places severe restrictions on certain firearm parts in an effort to ban home built firearms.  The language is vague and overly broad, with felony penalties for violations. It fails to recognize that prohibited persons cannot lawfully possess any firearm, whether home built or produced by a licensed manufacturer. Additionally, the bill uses your tax dollars to create a commission to research “gun violence.” While the NRA does not oppose objective research, this will produce biased advocacy instead of sound science. Senate Bill 3054 SD 2 requires notice of permanent removal of a firearm outside the state, with the registering county, within five days. A penalty of $100 per firearm will be assessed for non-compliance.

RAY: A ‘Temporary’ Swamp Creature Might Have Gained Some Credibility

Only in the stagnant swamps of Washington, DC, could a public policy with the word “temporary” in its title gain a sense of permanence, but that is exactly what has happened to Temporary Protected Status (TPS).TPS was a benevolent policy enacted in 1990 to provide temporary safe haven to those who were visiting or temporarily living in the United States – such as tourists or students – when civil strife or a natural disaster suddenly struck back home, making their immediate return either very difficult or dangerous. Consider a situation where your neighbor’s house floods and you offer the comforts of your living room to the displaced family so they have somewhere safe to live while their home is being repaired. Except in the case of TPS, the people residing in your living room never go home. And they invite their family members, who are not even in the U.S. yet, to move in as well. The near permanence of TPS can be seen by considering the fact that today, there are more than 400,000 TPS recipients from ten countries in the United States. A large number of these recipients are from Central America, and received TPS at the turn of the century – roughly 20 years ago – due to the damages inflicted by Hurricane Mitch. Not one of these countries was a paradise before the hurricane struck, and they aren’t likely to become a paradise if we extend TPS for another 20 years. But the countries have had decades to recover and their displaced citizens should return home. In addition to its failure to be temporary, TPS has other problems as well. For many, it became a magnet for illegal immigration. Once a country was granted TPS, for example, those wishing to reside in the U.S. and obtain coveted work permits simply rushed the borders, knowing that they would likely be able to benefit from the quasi-permanent protected status like many of their fellow countrymen. Early on, the Trump administration recognized the inherent problems with TPS and moved to restore its original objective and integrity by ending the status for those who had been here for decades and whose countries had sufficient time to heal. Unfortunately, activist judges immediately issued injunctions, ensuring TPS would remain in place for the countries in question. The problem with never sending home TPS recipients is that it tells the American public that the policy has no credibility. Allowing someone to remain here temporarily because of a sudden disaster back home is not a promise of permanent residence, nor is it path to citizenship. It is a short-term offer of humanitarian assistance. If the public loses faith in the credibility of the program because beneficiaries never go home, then the ability of Congress to extend this program to future populations could be called into question. Thankfully, and to the surprise of many who long ago had given up on a sensible immigration-related ruling coming out of the Ninth Circuit Court of Appeals, the court recently overruled the lower courts and cleared the way for the Trump Administration to end TPS for four nations: El Salvador, Haiti, Nicaragua and Sudan. This momentous ruling is not only a win for the American people, but for the rule of law, while also serving as a strong rebuke to activist judges who have decided that they have the authority to make immigration policy from the bench. The decision affirms two very important aspects of TPS. First, it reminds its recipients that the “T” in TPS stands for temporary, and that they should never have the expectation that they will be staying here long term or that they are on a path to citizenship. The second aspect of the ruling that is of critical importance is that it affirms that the Department of Homeland Security, along with other relevant federal agencies, has clear and unambiguous authority and discretion to oversee the program and decide when those who are benefitting from TPS should return home. Prior to this ruling it could be argued that TPS should be abolished all together because it couldn’t be administered and enforced in the way it was intended.  Now, perhaps, the courts have shown us that this humanitarian policy just might be able to work after all. Perhaps the swamp is actually changing. Dave Ray is director of communications at the Federation for American Immigration Reform (FAIR), a nonprofit group advocating for legal immigration.

Michigan Woman Places Toilet Outside Home As Mail-In Ballot Dropbox, Authorities Investigating

A Michigan woman who appeared to have displayed a toilet on her lawn to make a mockery of mail-in voting is now being investigated by authorities. The unidentified woman from the city of Mason placed a toilet on the edge of her lawn along with a sign that read “Place mail in ballots here,” according to the Associated Press. The Democratic clerk of Ingham County Barb Byrum filed a complaint with police, saying it was misleading and could cause people who aren’t familiar with the voting system to dump their ballots in the toilet. “It is a felony to take illegal possession of an absentee ballot,” Byrum said Friday, according to an official statement. “Elections in this country are to be taken seriously and there are many people who are voting by mail for the first time this Election,” she added. Absentee ballot election workers stuff ballot applications at the Mecklenburg County Board of Elections office in Charlotte, North Carolina on September 4, 2020. (Photo by Logan Cyrus / AFP) (Photo by LOGAN CYRUS/AFP via Getty Images) Byrum said she feared the stunt would cause voters to lose faith in the mail-in voting process, citing “misinformation coming from President Trump” as one of the reasons people are skeptical of the system. Lindsey Graham Doubles Down On Filling Seat After Originally Saying He Wouldn’t Support Nomination Of Justice During Election Year

Republican South Carolina Sen. Lindsey Graham doubled down Sunday on his promise to go ahead with the Senate process to confirm a new Supreme Court justice.“Being lectured by Democrats about how to handle judicial nominations is like an arsonist advising the Fire Department,” Graham tweeted. Schumer And Ocasio-Cortez Say Americans Agree With Ginsburg’s Last Wish That SCOTUS Seat Be Filled By ‘A New President’

New York Democratic Sen. Chuck Schumer and New York Rep. Alexandria Ocasio-Cortez said Sunday that “a new president” should fill the Supreme Court seat vacant upon the death of Justice Ruth Bader Ginsburg.Schumer suggested Americans of all political stripes agree with Ginsburg’s reported last wish that her seat not be filled immediately. “She was an amazing woman,” Schumer told supporters at New York’s James Madison High School where Ginsburg attended classes as a young woman. (RELATED: Lindsey Graham Backs Trump’s Push To Fill Ginsburg Seat) “So the first reason we’re here is for unity and the second is to honor her legacy. To demand that her last wish be fulfilled by the Senate. She said, ‘my most fervent wish is that I will not be replaced by — until a new president is installed.’” Schumer said, “We believe that,” and suggested a majority of Americans do as well, citing a Reuters/Ipsos poll indicating that 62% of respondents agree with Ginsburg. “So that means, that’s such a high number, it means that Democrats, Republicans and Independents all agree that it is only right and it is only fair for us to abide by RBG’s last wish, that she be replaced when a new president is installed.” Ocasio-Cortez urged Democrats to use “every tool at our disposal” to stop the Senate confirming anyone nominated by President Donald Trump, according to the New York Post. “We need to make sure we mobilize on an unprecedented scale to ensure this vacancy is reserved for the next president,” she said. Ginsburg passed away Friday at the age of 87. “We must also commit to using every procedural tool available to us to ensure that we buy ourselves the time necessary,” said Ocasio-Cortez. Trump indicated Saturday that he intends to nominate a replacement “without delay” and McConnell has promised to deliver a vote on that nomination. BARR: Democrat Hysteria Will Undermine The Very Institutions They Claim To Be Protecting

It is easy to understand the fear in the minds of Democrat Party leaders prompted by President Trump and Senate Majority Leader McConnell stating that they will in fact move forward to nominate and schedule a confirmation vote for a replacement for recently-deceased Supreme Court Justice Ginsburg. That fear has ignited a barrage of proposals that prove beyond doubt the Democrats will stop at nothing to deny Trump a third appointment to the Court and to deny Republicans any future opportunities. They will stop at nothing. It is by no means certain that McConnell could muster 50 votes to confirm Trump’s nominee, but if he does it would result in a potential 6-3 “conservative” majority on the High Court. This drives abject fear into the very core of the Democrat Party and the pro-abortion movement in this country. The possibility of a Supreme Court that might to even a tiny degree limit abortion rights is a danger to be opposed with every tool possible, regardless of how such actions might damage the Court, the Senate, or the Constitution itself. The irrationality and borderline idiocy of some of the statements by Democrat leaders is stunning, even by today’s loose standards. Democratic Minnesota Sen. Amy Klobuchar declared that the Republicans “stole” the last appointment to the Court (the 2018 confirmation of Brett Kavanaugh) and that the GOP is now “trying to do it again.” Actually, all President Trump has said he intends to do is exercise his clear constitutional prerogative and submit a nominee to the Senate for its “advice and consent”; nothing more, nothing less, and hardly indicative of “stealing” anything. Democratic Hawaii Sen. Mazie Hirono, never one to let civil discourse get in the way of intemperate rantings, said publicly that her party will be considering all manner of moves to not only prevent the Ginsburg vacancy from being filled, but to ensure that future Supreme Court vacancies will be handled in such way as to all-but-guarantee only Democrat-friendly nominees will be approved by the Senate. For example, the Hawaiian firebrand declared her party will move to pack the court with more justices than the nine allowed since 1869 by federal law. As further evidence of the extreme steps to which the Democrat Party will go to ensure it gains a lock on future High Court nominations, Hirono declared they will press statehood for Puerto Rico (to gain the two senatorial seats that almost certainly would be theirs if the island were to become the 51st state), and also end the Senate filibuster should her Party regain a majority in the November 3rd election. Former Obama Attorney General Eric Holder echoed calls to pack the Court with more justices, to be filled by nominees offered by hoped-for President Biden and a Democrat-controlled Senate come January 2021. New York Rep. Jerrold Nadler, still smarting from his failed impeachment effort earlier this year, was quick to jump on the court-packing bandwagon. From his perspective, which not surprisingly is shared by former President Obama and 2016 presidential nominee Hillary Clinton, any move by Trump and McConnell to fill the Ginsburg vacancy this year is tantamount to a capital offense. This perspective pervades all levels of the Democrat Party despite there being no prohibition whatsoever — in the Constitution, in federal law, or in historic precedent — on the president taking steps to fill the Court vacancy. Already, “impeachment” has been floated as retribution against Trump and Attorney General Bill Barr. The basis for such a move is far from clear, but for today’s Democrats clarity and reason count for nothing. The Democrat hysteria churned up by Ginsburg’s passing is unprecedented; beyond even the despicable attacks on Kavanaugh during his Senate confirmation hearings two years ago. Every possible avenue to defeat a vote on a new associate justice, no matter how deeply it might undermine the integrity of institutions that have been at the heart of our constitutional republic’s survival, is being considered actively by the Democrats. Unfortunately, the Democrats may enlist a few Republican senators as allies in their drive to undermine the integrity of the very institutions they claim hypocritically to be rescuing from Trump’s actions. If so, the tragedy of what they are advocating may actually come to pass. Bob Barr represented Georgia’s 7 District in the U.S. House of Representatives from 1995 to 2003 and was the U.S. Attorney for the Northern District of Georgia from 1986 to 1990.  He now serves as President of the Law Enforcement Education Foundation based in Atlanta, Georgia.

Trump Says If Democrats Impeach Him Over SCOTUS Nominee, It Will Help Republicans In 2020 Election

President Donald Trump said Monday morning that if Congressional Democrats try to impeach him a second time, it will only help him and other Republicans in the 2020 election.House Speaker Nancy Pelosi didn’t rule out the idea of impeaching Trump and Attorney General Bill Barr to disrupt Trump’s nomination process for the late Supreme Court Justice Ruth Bader Ginsburg’s replacement. (Photo by Sarah Silbiger/Getty Images) “We have our options,” she stated when specifically asked about the idea by host George Stephanopoulos. “We have arrows in our quiver that I’m not about to discuss right now.” Trump Monday responded by telling the Fox & Friends crew that Pelosi and Democrats would be impeaching him “for doing constitutionally what I have to do… I think then we win the election, then we win all elections if they do that.” Trump clarified that he wasn’t trying to goad Pelosi into impeaching him, but added that should it happen, his “numbers will go up.” (RELATED: Here Are The Women At The Top Of Trump’s List To Replace Justice Ruth Bader Ginsburg) The president then stated that impeachment would help Republicans “win back the house” and help Republican Senators Susan Collins of Maine and Lisa Murkowski of Alaska, both of whom have stated they would not vote on a Supreme Court confirmation ahead of the 2020 election. WATCH: Later in the interview, Trump stated he planned to announce his nomination on Friday or Saturday, following the conclusion of memorial services for Ginbsurg. He additionally praised Judge Merrick Garland, who former President Barack Obama nominated to fill the vacancy left by Justice Antonin Scalia’s passing in 2016. Garland’s confirmation was blocked by Senate Majority Leader Mitch McConnell. “I think Merrick Garland is an outstanding judge,” Trump stated. “I think he’s outstanding, and I think he’s an outstanding intellect. He is liberal. That’s okay, but the only problem was — and this is up to the Senate — the only problem was President Obama did not have the Senate.”

FACT CHECK: Was Netflix CEO Kim Martin Morrow Arrested On Child Pornography Charges?

A post shared on Facebook claims Kim Martin Morrow, purportedly the CEO of Netflix, was arrested on child pornography charges.Verdict: False Netflix’s CEO is not named Kim Martin Morrow. The streaming service’s two CEOs, Reed Hastings and Ted Sarandos, have not been charged with possession of child pornography. Fact Check: In September 2020, a rumor on social media falsely claimed Netflix’s Hastings, was arrested for possession of over 13,000 images of child pornography. Days later, social media users began sharing posts claiming that Morrow is the CEO of Netflix and that he was “charged with 15 charges for child pornography.” But, like the claim about Hastings, the claim that Morrow was arrested for possession of child pornography has been fabricated. The only two CEOs of Netflix are Hastings and Sarandos, who also serves as the company’s chief content officer, according to the Netflix investor’s website. No one with Morrow’s name is listed as holding a high-ranking leadership position on the streaming service’s website. Had such a senior leader from Netflix been arrested, it would have made headlines, yet Check Your Fact found no credible media reports covering such an arrest. (RELATED: No, Netflix CEO Reed Hastings Was Not Arrested For Possession Of Child Pornography) These claims appear to have started circulating amid Netflix receiving backlash from viewers and politicians about the movie “Cuties,” a French film about an 11-year-old girl that joins other young girls in a dance group “named ‘the cuties’ at school, and rapidly grows aware of her burgeoning femininity – upsetting her mother and her values in the process,” according to the movie’s description on IMDb. Some viewers and politicians have criticized the film for allegedly sexualizing young girls, according to The Associated Press. Republican Texas Sen. Ted Cruz called for an investigation of the streaming platform by the Justice Department to “determine whether Netflix, its executives, or the individuals involved in the filming and production of ‘Cuties’ violated any federal laws against the production and distribution of child pornography,” according to a letter Cruz sent to Attorney General William Barr. Netflix defended the film in statements that echo director Maïmouna Doucouré, saying that “Cuties” is a “social commentary against the sexualization of young children,” per The Washington Post.
